【摘要】：數(shù)字化的普及催生了新的證據(jù)——數(shù)字證據(jù)(在我國稱為電子證據(jù))。由于數(shù)字/電子證據(jù)對(duì)信息技術(shù)的強(qiáng)依賴特性,在證據(jù)的收集、鑒定、認(rèn)證等規(guī)則上有著不同于傳統(tǒng)證據(jù)的諸多特點(diǎn),給各國司法實(shí)踐中傳統(tǒng)證據(jù)法和證據(jù)規(guī)則的運(yùn)用帶來了極大挑戰(zhàn)。針對(duì)這一話題,北美的《數(shù)字環(huán)境中的證據(jù)法》項(xiàng)目在2015年發(fā)布了一份階段性報(bào)告。本文介紹了該項(xiàng)目的研究成果,結(jié)合我國的現(xiàn)狀探討其研究結(jié)論在我國的適用性,并在基礎(chǔ)上對(duì)比我國與北美環(huán)境下數(shù)字/電子證據(jù)狀況的異同,引出下一階段的研究問題。
[Abstract]:The popularity of digitization has given birth to new evidence-digital evidence (known as electronic evidence in our country). Due to the strong dependence of digital / electronic evidence on information technology, the collection and identification of evidence, Authentication and other rules have many characteristics different from the traditional evidence, which brings great challenges to the application of the traditional evidence law and the evidence rules in the judicial practice of various countries. The "evidence in the Digital Environment" project in North America published a periodic report in 2015. This paper introduces the research results of the project, and discusses the applicability of the research conclusions in our country according to the present situation of our country. On the basis of the comparison of the digital / electronic evidence between China and North America, the next stage of research is brought forward.
