【摘要】：司法裁判理論是美國(guó)法理學(xué)核心問(wèn)題之一。其中,法律形式主義與法律現(xiàn)實(shí)主義的爭(zhēng)執(zhí)貫穿始終、交替登臺(tái)。塔瑪納哈則否認(rèn)在美國(guó)存在法律形式主義時(shí)期,并試圖糾正將法律現(xiàn)實(shí)主義歸結(jié)為極端規(guī)則懷疑主義的傳統(tǒng)認(rèn)識(shí)。在此基礎(chǔ)上,他提出了"司法裁判均衡現(xiàn)實(shí)主義"理論,將規(guī)則約束與規(guī)則懷疑作為其均衡現(xiàn)實(shí)主義的兩個(gè)基點(diǎn),不僅試圖重塑法律現(xiàn)實(shí)主義的形象,而且要重構(gòu)司法裁判理論。
[Abstract]:The theory of judicial adjudication is one of the core issues of American jurisprudence. Among them, the dispute between legal formalism and legal realism runs through all the time, and alternately comes on stage. Tamanaha denies the existence of legal formalism in the United States. On the basis of this, he puts forward the theory of "balanced realism of judicial adjudication", and tries to correct the traditional understanding that legal realism is reduced to extreme rule skepticism. Taking rule constraint and rule doubt as the two basic points of equilibrium realism, not only trying to reconstruct the image of legal realism, but also reconstructing the theory of judicial judgment.
