【摘要】：檢察官懲戒委員會(huì)的建構(gòu)是懲戒機(jī)構(gòu)專門化的體現(xiàn)。在機(jī)構(gòu)設(shè)置和人員組成上,檢察官懲戒委員會(huì)應(yīng)設(shè)置在檢察機(jī)關(guān)之外,以保證其獨(dú)立性;檢察官懲戒委員會(huì)的組成人員應(yīng)引入檢察系統(tǒng)以外的人士,并科學(xué)設(shè)置比例,以保證其客觀性;檢察官遴選委員會(huì)或考評(píng)委員會(huì)可以與檢察官懲戒委員會(huì)合并設(shè)立,且不宜固定化,以免形成尋租空間;在檢察官懲戒制度之外可以設(shè)立檢察官?gòu)椲乐贫�。在職�?zé)權(quán)限與懲戒程序上,要不要賦予檢察官懲戒委員會(huì)獨(dú)立的調(diào)查權(quán)和一定程度的決定權(quán),尚需深入探討。
[Abstract]:The construction of the disciplinary committee of the prosecutor is the embodiment of the specialization of the disciplinary institution. In terms of the establishment of the institution and the composition of the personnel, the disciplinary committee of the prosecutor should be set outside the procuratorial organ in order to ensure its independence; The composition of the Public Prosecutor's Disciplinary Committee shall be introduced to persons outside the prosecutorial system and shall be scientifically proportional in order to ensure its objectivity; the Public Prosecutor selection Committee or the Evaluation Committee may be established in conjunction with the Prosecutor's Corrections Committee, And it should not be fixed so as not to form a rent-seeking space; the impeachment system of procurators can be set up outside the disciplinary system of prosecutors. Whether to give independent investigation power and certain decision power to the Public Prosecutor's Corrections Commission still needs to be discussed in depth.
