【摘要】：正修改后的《人民檢察院刑事訴訟規(guī)則(試行)》(以下簡稱《規(guī)則》)明確規(guī)定死刑執(zhí)行臨場監(jiān)督由人民檢察院監(jiān)所檢察部門負(fù)責(zé)。筆者結(jié)合參與監(jiān)督法院執(zhí)行死刑過程的實踐,對死刑執(zhí)行臨場監(jiān)督制度諸多需要完善之處進(jìn)行探討。一、完善我國死刑執(zhí)行臨場監(jiān)督制度的必要性死刑是我國最嚴(yán)厲的刑罰,檢察機(jī)關(guān)通過科學(xué)完善的死刑執(zhí)行臨場監(jiān)督制度,確保死刑執(zhí)行在法
[Abstract]:The revised Criminal procedure rules of the people's Procuratorate (hereinafter referred to as "the rules") clearly stipulate that the supervision of the execution of the death penalty on the spot shall be the responsibility of the procuratorial department of the prison of the people's procuratorate. The necessity of perfecting the supervision system of execution on the spot of death penalty in our country is the most severe punishment in our country.
