內(nèi)部行政行為可訴性研究

【摘要】:行政行為可以被分為內(nèi)部行政行為與外部行政行為,而此種界分是建立在行政行為所具體作用的對(duì)象的基礎(chǔ)上。內(nèi)部行政行為是指行政主體在內(nèi)部的行政組織管理中僅針對(duì)行政組織內(nèi)部做出并對(duì)其產(chǎn)生法律效力的行為。對(duì)內(nèi)部行政行為的可訴性研究源于行政訴訟法的相關(guān)規(guī)定。其中,我國(guó)現(xiàn)行《行政訴訟法》第12條第3款規(guī)定:行政機(jī)關(guān)對(duì)行政機(jī)關(guān)工作人員的獎(jiǎng)懲、任免等決定,不屬于人民法院行政訴訟受案范圍。 內(nèi)部行政行為可訴性內(nèi)涵解析與國(guó)外立法現(xiàn)狀。可訴性的內(nèi)涵解析,主要從內(nèi)部行政行為的概念、內(nèi)部行政行為與外部行政行為的界分以及可訴性的內(nèi)涵三個(gè)方面來(lái)解析,以便準(zhǔn)確把握內(nèi)部行政行為可訴性的內(nèi)涵。此外我國(guó)內(nèi)部行政行為可訴性的立法現(xiàn)狀中列舉我國(guó)目前關(guān)于內(nèi)部行政行為的所有的救濟(jì)方式。最后比較了英美法系和大陸法系關(guān)于內(nèi)部行政行為可訴性研究的現(xiàn)狀,得出內(nèi)部行政行為在國(guó)外已部分可訴,,我們可以借鑒。 必要性和可行性是內(nèi)部行政行為可訴性研究中的兩個(gè)重要方面,因而此部分主要著重從這兩方面來(lái)陳述。其中,內(nèi)部行政行為可訴的必要性源于理論上的影響,實(shí)踐中侵權(quán)行為的存在和內(nèi)部救濟(jì)不順暢。另外司法權(quán)、行政權(quán)和人權(quán)觀念都直接影響了內(nèi)部行政行為是否具有訴訟的必要性。而內(nèi)部行政行為可訴的可行性主要論述了其理論支撐和實(shí)踐基礎(chǔ)。 研究?jī)?nèi)部行政行為可訴性的核心問題是明確內(nèi)部行政行為可訴性范圍。之所以具有核心意義,是因?yàn)樾姓V訟的目的是將行政機(jī)關(guān)的行政行為納入司法審查,最終能夠保護(hù)內(nèi)部行政相對(duì)人的合法權(quán)益,而內(nèi)部行政行為內(nèi)容的復(fù)雜性與廣泛性決定了我們不可能將可訴的內(nèi)部行政行為一一列舉,因而研究?jī)?nèi)部行政行為可訴的標(biāo)準(zhǔn)也就具有重要的意義,而此種可訴性的標(biāo)準(zhǔn)可以概括為宏觀標(biāo)準(zhǔn)和微觀標(biāo)準(zhǔn),宏觀標(biāo)準(zhǔn)中的司法權(quán)有干涉行政權(quán)的必要性適用于立法過(guò)程中。微觀標(biāo)準(zhǔn)涵蓋了內(nèi)部行政行為的做出違反相關(guān)法律規(guī)定、內(nèi)部行政行為侵犯了相對(duì)人合法的人身權(quán)和財(cái)產(chǎn)權(quán)、內(nèi)部行政行為是一種完成性的行政行為以及相對(duì)人已窮盡行政內(nèi)部救濟(jì),其主要適用于具體的司法實(shí)踐中。另外在確立的標(biāo)準(zhǔn)下再輔以幾種特殊的可訴內(nèi)部行政行為研究能夠使得內(nèi)部行政行為可訴性的研究更加全面。
[Abstract]:Administrative acts can be divided into internal administrative acts and external administrative acts. This kind of demarcation is based on the object of the specific function of the administrative act. The internal administrative act refers to the administrative subject who only makes the administrative act within the administrative organization and produces the legal effect on it in the management of the internal administrative organization. Behavior. The research on the justiciability of the internal administrative act originates from the relevant provisions of the Administrative procedure Law. Article 12, paragraph 3, of the present Administrative procedure Law of our country stipulates that the decision of the administrative organ to reward and punish the staff of the administrative organ, to appoint or remove the staff, and so on, does not fall within the scope of the administrative litigation case of the people's court. The connotation analysis of internal administrative act actionable and the present situation of foreign legislation. The connotation analysis of justiciability mainly from the concept of internal administrative act. This paper analyzes the boundary between internal administrative act and external administrative act and the connotation of actionable. In order to accurately grasp the connotation of the justiciability of the internal administrative act. In addition, in the present legislative situation of the actionable nature of the internal administrative act in our country, all the remedies concerning the internal administrative act in our country are listed. Finally, the common law system is compared. And the current situation of the research on the justiciability of internal administrative acts in the civil law system. Draw the conclusion that the internal administrative acts in foreign countries have been partially actionable, we can use for reference. Necessity and feasibility are two important aspects in the study of the justiciability of internal administrative action, so this part mainly focuses on these two aspects. The necessity of internal administrative action can be sued from the influence of theory, the existence of tort and internal remedy are not smooth in practice. In addition, judicial power. The concept of administrative power and human rights has a direct impact on the necessity of litigation in internal administrative action, while the feasibility of actionable internal administrative act mainly discusses its theoretical support and practical basis. The core problem of the study on the justiciability of internal administrative acts is to clarify the scope of the justiciability of internal administrative acts. The reason is that the purpose of administrative litigation is to bring the administrative acts of administrative organs into judicial review. Ultimately can protect the legitimate rights and interests of the internal administrative counterpart, and the complexity and universality of the content of the internal administrative act determines that we can not list one by one the internal administrative acts that can be sued. Therefore, it is of great significance to study the standards of internal administrative action, which can be summarized as macro and micro standards. The necessity of the judicial power to interfere with the executive power in the macro standard is applicable to the legislative process. The micro standard covers the violation of the relevant legal provisions by the making of the internal administrative act. The internal administrative act has violated the relative person's legal personal right and the property right, the internal administrative behavior is a kind of complete administrative act and the relative party has exhausted the administrative internal relief. It is mainly applicable to the specific judicial practice. In addition, under the established standards and supplemented by several special research on the internal administrative act of actionable can make the research of the internal administrative act actionable more comprehensive.
