我國檢察職權(quán)配置研究

【摘要】:檢察職權(quán)配置是司法職權(quán)配置的重要內(nèi)容,也是司法改革的重要環(huán)節(jié)。檢察職權(quán)的有效運(yùn)行,很大程度上決定著我國司法體制的建立、健全與完善。然而檢察職權(quán)實(shí)際運(yùn)作過程中受到多方干擾,導(dǎo)致檢察職權(quán)不能有效行使。目前,我國檢察職權(quán)配置存在諸多問題,主要有內(nèi)部和外部兩方面因素影響檢察職權(quán)配置的優(yōu)化,文章將檢察機(jī)關(guān)定性為法律監(jiān)督機(jī)關(guān),基于此,筆者以司法改革為視角,剖析檢察職權(quán)配置中存在的法律問題和配置不足。通過完善立法、改革檢察體制、優(yōu)化職能范圍、提升檢察機(jī)關(guān)司法權(quán)威及公信力等相關(guān)措施,優(yōu)化檢察職權(quán)配置,防止權(quán)力濫用。本文分為六個部分:第一章:通過論述檢察權(quán)的性質(zhì)是司法權(quán),檢察制度是由人類發(fā)展而來為背景。我國從清末檢察制度的引進(jìn)到司法改革中檢察職權(quán)配置,我國檢察職權(quán)存在的配置缺陷,一直是法學(xué)理論界研究的課題。結(jié)合國內(nèi)外關(guān)于檢察職權(quán)配置研究現(xiàn)狀,試圖系統(tǒng)分析出我國檢察職權(quán)配置缺陷,探尋司法改革的良方。第二章:理論分析檢察職權(quán)的法理基礎(chǔ)是受到西方權(quán)力制約理論的影響,保障法律的統(tǒng)一適用和促進(jìn)司法公正同時作為檢察職權(quán)配置的法理基礎(chǔ),為檢察職權(quán)設(shè)置與改革提供理論支持。憲法性文件對檢察職權(quán)配置的定位、訴訟法的分散規(guī)定,以及檢察院組織法的細(xì)化,都對檢察職權(quán)的法律性質(zhì)做了自上而下的規(guī)定。第三章:論述司法改革視角下我國檢察職權(quán)配置存在的法律問題,從外部權(quán)力干涉檢察職權(quán)配置和內(nèi)部權(quán)力配置缺陷兩大方面出發(fā)分析原因,強(qiáng)調(diào)加快檢察職權(quán)配置的完善,以提高我國司法公正性。第四章:論述在司法改革視角下優(yōu)化檢察職權(quán)配置的建議宜從完善憲法出發(fā),修改完善相關(guān)法律規(guī)范,保障檢察職權(quán)配置的合理性。同時改革完善檢察體制、優(yōu)化檢察職權(quán)職能范圍以及提升檢察機(jī)關(guān)司法權(quán)威及公信力。第五章:鑒于檢察職權(quán)配置是為提高司法公正,然而檢察機(jī)關(guān)作為法律監(jiān)督機(jī)關(guān)享有監(jiān)督其他機(jī)關(guān)的權(quán)力,但是監(jiān)督檢察職權(quán)配置過程的機(jī)制應(yīng)不斷完善。本章為擴(kuò)大司法公開范圍、開放新媒體監(jiān)督平臺、強(qiáng)化紀(jì)檢部門監(jiān)督權(quán)三個方面探尋檢察職權(quán)濫用的監(jiān)督制約機(jī)制。第六部分:結(jié)語。
[Abstract]:The allocation of procuratorial power is an important part of judicial power allocation and also an important link of judicial reform. The effective operation of procuratorial power determines to a great extent the establishment of judicial system in our country. Perfect and perfect. However, there are many interference in the actual operation of procuratorial power, leading to the procuratorial power can not be effectively exercised. At present, there are many problems in the allocation of procuratorial power in China. There are two main internal and external factors affecting the optimization of procuratorial power allocation, the article will determine the procuratorial organ as a legal supervision organ, based on this, the author takes judicial reform as the perspective. Through perfecting the legislation, reforming the procuratorial system, optimizing the scope of functions, improving the judicial authority and credibility of procuratorial organs and other relevant measures. This paper is divided into six parts: the first chapter: by discussing the nature of procuratorial power is judicial power. The procuratorial system comes from the human development background. From the introduction of the procuratorial system in the late Qing Dynasty to the judicial reform, the allocation of procuratorial power in China is flawed. It has always been a research topic in the field of legal theory. Combined with the present situation of the domestic and foreign research on the allocation of procuratorial powers, this paper tries to systematically analyze the defects of the allocation of procuratorial powers in China. The second chapter: theoretical analysis of procuratorial powers of the legal basis is affected by the western theory of power constraints. Guarantee the unified application of the law and promote judicial justice as the legal basis for the allocation of procuratorial powers, and provide theoretical support for the establishment and reform of procuratorial powers. The decentralized provisions of the procedure law and the refinement of the law on the organization of the Public Prosecutor's Office. The third chapter discusses the legal problems existing in the disposition of procuratorial power in China from the perspective of judicial reform. From the external power interference procuratorial power allocation and internal power allocation defects from two major aspects of the analysis of reasons, emphasizing on speeding up the improvement of procuratorial power allocation. In order to improve the judicial fairness of our country. Chapter 4th: to discuss how to optimize the disposition of procuratorial powers from the perspective of judicial reform, from the point of view of improving the constitution, to modify and perfect the relevant legal norms. At the same time, we should reform and perfect the procuratorial system. Optimize the scope of procuratorial functions and enhance the judicial authority and credibility of procuratorial organs. Chapter 5th: since the allocation of procuratorial powers is to improve judicial justice. However, the procuratorial organ, as a legal supervision organ, has the power to supervise other organs, but the mechanism of supervising the disposition of procuratorial power should be improved continuously. This chapter is to expand the scope of judicial publicity and open the new media supervision platform. Strengthen the supervision power of discipline inspection departments from three aspects to explore the supervision and restriction mechanism of the abuse of procuratorial power. Part 6th: conclusion.
