【摘要】：江偉老師的民事訴訟基本理論研究建樹(shù)頗豐,其對(duì)于民事訴訟基本理論的各方面研究都是走在了當(dāng)時(shí)時(shí)代的前沿,并結(jié)合司法實(shí)踐、關(guān)注實(shí)踐問(wèn)題。江偉老師在長(zhǎng)期的研究過(guò)程中逐步將民事訴訟基本理論體系的內(nèi)容明確為包括民事訴訟價(jià)值理論、民事訴訟目的理論、訴權(quán)理論、訴訟標(biāo)的理論和既判力理論。本文從江偉老師民事訴訟基本理論體系的基石理論——民事訴訟價(jià)值理論入手,深入分析其強(qiáng)調(diào)“程序內(nèi)在獨(dú)立價(jià)值”的司法實(shí)踐上的動(dòng)因及學(xué)術(shù)理論上的基礎(chǔ),并以此為展開(kāi)對(duì)江偉老師的民事訴訟基本理論體系構(gòu)建中的細(xì)節(jié)加以研究、分析,并就其民事訴訟各基本理論本身在新的社會(huì)情況下及遭遇理論挑戰(zhàn)時(shí)的處理與應(yīng)對(duì)進(jìn)行再思考,以進(jìn)一步揭示江偉老師在民事訴訟基本理論體系中的深刻學(xué)術(shù)思想。
[Abstract]:Jiang Wei's research on the basic theory of civil procedure has made a lot of achievements. His research on all aspects of the basic theory of civil procedure was at the forefront of the times and combined with judicial practice. Attention to practical issues. In the long process of research, Jiang Wei gradually defined the content of the basic theoretical system of civil action, including the theory of value of civil action, the theory of purpose of civil litigation, and the theory of right of action. The theory of object of litigation and the theory of res judicata. This paper starts with the theory of civil litigation value, which is the cornerstone of Jiang Wei's basic theory system of civil litigation. It deeply analyzes the causes of judicial practice and the academic theoretical basis of emphasizing the "intrinsic independent value of procedure", and studies the details in the construction of the basic theoretical system of civil litigation of Mr. Jiang Wei. The author analyzes and rethinks the basic theories of civil action in the new social situation and when facing the theoretical challenge. In order to further reveal Jiang Wei's profound academic thoughts in the basic theoretical system of civil litigation.
