【摘要】：民事抗訴制度是具有中國特色的民事訴訟制度,學(xué)界質(zhì)疑民事抗訴系檢察權(quán)"介入"民事訴訟,與傳統(tǒng)的以兩造當(dāng)事人平等對席、法官居中裁判的等腰三角形結(jié)構(gòu)為基本樣式之典型民事訴訟的原理不相融。從構(gòu)造層面分析,1991年《民事訴訟法》框架下的民事抗訴制度屬于"兩階構(gòu)造",確實存在前述問題。但經(jīng)過2007年和2012年《民事訴訟法》的修改,民事抗訴制度形成了全新的"五階構(gòu)造",包含了前后相續(xù)的雙等腰三角形的關(guān)系結(jié)構(gòu)。新構(gòu)造下的民事抗訴制度與再審之訴制度在程序構(gòu)造和通行原則上遵循同樣的原理,表明民事抗訴制度新構(gòu)造與典型民事訴訟存在著原理相融性。
[Abstract]:Civil protest system is a civil litigation system with Chinese characteristics. Scholars have questioned that civil protest is a kind of procuratorial power to "intervene" in civil litigation, which is equal to the traditional "two parties". The principle of the typical civil action in which the equilateral triangle structure of the judge in the center is the basic pattern is not compatible. In 1991, the civil protest system under the framework of "Civil procedure Law" belongs to the "two-order structure", which does exist the above-mentioned problems, but after 2007 and 2012, the Civil procedure Law was amended. Civil protest system has formed a new "five-order structure". The civil protest system under the new structure and the retrial system follow the same principles in procedure construction and general principle. It shows that the new structure of civil protest system and the typical civil action have the same principle.
