【摘要】： 本文運用歷史分析、規(guī)范分析、比較研究和實證分析等方法對時效的發(fā)展歷史,行政時效的概念、要素、自身價值等各個方面進(jìn)行了較為系統(tǒng)的探討,并對我國行政時效制度的構(gòu)建提出了自己的建議。在對我國傳統(tǒng)行政時效的價值觀反思的基礎(chǔ)上,提出行政時效應(yīng)實現(xiàn)秩序、正義、自由、公平和效率等法的價值,行政時效制度在控制行政權(quán)力的前提下確保行政主體和行政相對人的效率,實現(xiàn)行政正義和行政自由。
[Abstract]:By using the methods of historical analysis, normative analysis, comparative study and empirical analysis, this paper makes a systematic discussion on the development history of prescription, the concept of administrative prescription, the elements, the value of itself, and so on. And put forward their own suggestions on the construction of the administrative prescription system in our country. On the basis of reflection on the values of traditional administrative prescription in our country, this paper puts forward that administrative prescription should realize the value of law such as order, justice, freedom, fairness and efficiency, etc. Under the premise of controlling administrative power, administrative prescription system ensures the efficiency of administrative subject and administrative counterpart, and realizes administrative justice and administrative freedom.
