【摘要】：法律的目的在于建立一個(gè)公平的秩序，同時(shí)恢復(fù)被扭曲的公平與正義。換而言之，其功能在于實(shí)現(xiàn)實(shí)質(zhì)上的正義，以法律的力量，賦予人們以權(quán)力，通過(guò)對(duì)權(quán)利義務(wù)的設(shè)定實(shí)現(xiàn)這一目的。由于社會(huì)生活的復(fù)雜性，，在不同的領(lǐng)域都存在強(qiáng)弱力量的對(duì)比，國(guó)際商事領(lǐng)域同樣如此。隨著我國(guó)對(duì)外經(jīng)濟(jì)交往的增多，對(duì)國(guó)際商事領(lǐng)域弱勢(shì)群體的利益進(jìn)行保護(hù)，就顯得刻不容緩，而法律是最有效的保護(hù)方式。 本文從宏觀的角度對(duì)國(guó)際商法中弱勢(shì)群體保護(hù)問(wèn)題進(jìn)行了論述，文章分四部分，第一章是從法理學(xué)的角度分析，指出弱勢(shì)群體保護(hù)的理論依據(jù)，并對(duì)國(guó)際商法中的弱勢(shì)群體的概念進(jìn)行了定義，劃定了范疇。第二章以國(guó)際產(chǎn)品責(zé)任法和國(guó)際保理法律制度為例，介紹了國(guó)際上現(xiàn)行實(shí)體法在國(guó)際商事領(lǐng)域?qū)θ鮿?shì)群體保護(hù)的規(guī)定。第三章介紹了國(guó)際商法沖突規(guī)范目前應(yīng)用在弱勢(shì)群體保護(hù)的沖突規(guī)則，并列舉了各國(guó)在國(guó)際保險(xiǎn)合同、國(guó)際消費(fèi)合同以及國(guó)際產(chǎn)品責(zé)任法中的具體適用的沖突規(guī)范，同時(shí)對(duì)中國(guó)的現(xiàn)行立法缺陷提出建議。第四章具體論述國(guó)際商法的追求平等正義的基本價(jià)值要求及對(duì)我國(guó)涉外商事立法的具體建議。 實(shí)質(zhì)公平是國(guó)際商法對(duì)弱者保護(hù)的基本價(jià)值取向，我國(guó)目前在國(guó)際商事許多領(lǐng)域都有立法空白，沒(méi)有相關(guān)的規(guī)定，因此筆者建議在商事立法時(shí)應(yīng)以保護(hù)弱者利益作為基本原則，同時(shí)輔以強(qiáng)制性規(guī)范，以國(guó)家公力協(xié)助恢復(fù)國(guó)際商事領(lǐng)域強(qiáng)弱群體的力量平衡。
[Abstract]:The aim of the law is to establish a fair order while restoring distorted fairness and justice. In other words, its function lies in the realization of substantive justice, the power of the law, the empowerment of people, through the establishment of rights and obligations to achieve this purpose. Because of the complexity of social life, there is a contrast between strength and strength in different fields, and the same is true in the field of international commerce. With the increase of foreign economic exchanges in China, it is urgent to protect the interests of vulnerable groups in the field of international commerce, and the law is the most effective way of protection. This paper discusses the protection of vulnerable groups in international commercial law from a macro point of view, the article is divided into four parts, the first chapter is from the point of view of jurisprudence, pointing out the theoretical basis of the protection of vulnerable groups, It also defines the concept of vulnerable group in international commercial law and delimits the category. The second chapter takes the international product liability law and the international factoring legal system as examples, and introduces the current international substantive law on the protection of vulnerable groups in the international commercial field. The third chapter introduces the conflict rules currently used in the protection of vulnerable groups, and enumerates the specific applicable conflict norms in international insurance contracts, international consumer contracts and international product liability law, which are applicable in international insurance contracts, international consumer contracts and international product liability laws. At the same time, the author puts forward some suggestions on the defects of China's current legislation. The fourth chapter discusses the basic value requirements of the pursuit of equality and justice in international commercial law and the specific suggestions on China's foreign commercial legislation. Substantive fairness is the basic value orientation of international commercial law for the protection of the weak. At present, there are legislative gaps in many areas of international commercial law, and there are no relevant provisions. Therefore, the author suggests that the protection of the interests of the weak should be taken as the basic principle in commercial legislation. At the same time, supplemented by peremptory norms, the national public power helps to restore the balance of strength of the strong and weak groups in the field of international commercial affairs.
