港口經(jīng)營(yíng)人法律主體研究

【摘要】: 港口經(jīng)營(yíng)人法律主體問(wèn)題在我國(guó)海商法領(lǐng)域具有重大的意義。我國(guó)的《海商法》和《港口法》未就港口經(jīng)營(yíng)人法律主體地位作出明確規(guī)定,因此港口經(jīng)營(yíng)人法律主體問(wèn)題在我國(guó)的司法實(shí)踐中爭(zhēng)議較大,法律適用不統(tǒng)一。 本文主要運(yùn)用比較的研究方法,對(duì)港口經(jīng)營(yíng)人的法律性質(zhì),港口經(jīng)營(yíng)人的法律責(zé)任及其責(zé)任限制問(wèn)題進(jìn)行了論證分析。對(duì)照英美等海運(yùn)大國(guó)有關(guān)港口經(jīng)營(yíng)人的立法及相關(guān)的國(guó)際海事立法狀況,并結(jié)合中國(guó)的司法實(shí)踐,進(jìn)行研究和探討。 本論文包括引言、正文,結(jié)語(yǔ)三部分,正文內(nèi)容分為三章。 第一章先對(duì)我國(guó)及國(guó)際上有關(guān)港口經(jīng)營(yíng)人的定義進(jìn)行闡述,并分析各國(guó)有關(guān)港口經(jīng)營(yíng)人的立法。 第二章著重分析了港口經(jīng)營(yíng)人的法律性質(zhì)。比較了各種有關(guān)港口經(jīng)營(yíng)人法律性質(zhì)的主要觀點(diǎn),在評(píng)價(jià)各種理論觀點(diǎn)的基礎(chǔ)上提出把港口經(jīng)營(yíng)人歸類于“履約方”的建議。 第三章主要分析了港口經(jīng)營(yíng)人的法律責(zé)任。首先分析港口經(jīng)營(yíng)人的責(zé)任類型,提出港口經(jīng)營(yíng)人的歸責(zé)原則和責(zé)任限制的觀點(diǎn),然后就完善港口經(jīng)營(yíng)人的法律責(zé)任提出立法建議:把港口經(jīng)營(yíng)人歸入“履約方”,明確港口經(jīng)營(yíng)人享有與承運(yùn)人相同的法律地位。
[Abstract]:The subject of the port operator's law is of great significance in the maritime law field of our country. China's Maritime Law and Port Law do not clearly stipulate the legal subject status of the port operator. Therefore, the subject of the port operator's legal subject is controversial in the judicial practice of our country, and the application of the law is not uniform. In this paper, the legal nature of the port operator, the legal liability of the port operator and the limitation of the liability are demonstrated and analyzed by means of comparative research methods. According to the legislation of port operators and related international maritime legislation in the major shipping countries such as Britain and the United States, and combining with the judicial practice of China, this paper studies and probes into the legislation of port operators and the related international maritime legislation. This paper includes the introduction, the text, the conclusion three parts, the text content is divided into three chapters. The first chapter expounds the definition of port operator in our country and international, and analyzes the legislation of port operator in various countries. The second chapter focuses on the analysis of the legal nature of port operators. This paper compares the main points of view about the legal nature of the port operator, and puts forward the suggestion of classifying the port operator into the "performing party" on the basis of evaluating the various theoretical viewpoints. The third chapter mainly analyzes the legal liability of the port operator. This paper first analyzes the types of responsibility of port operators, puts forward the principles of imputation and limitation of liability of port operators, and then puts forward some legislative suggestions on perfecting the legal liability of port operators: putting the port operators into the "performing party". It is clear that the port operator has the same legal status as the carrier.
