【摘要】： 海事留置權(quán)制度是適用于海事法律關(guān)系中的留置權(quán)制度,它有別于民法中的一般留置權(quán)制度,是海商法領(lǐng)域中的一項(xiàng)重要的法律制度,也是海事物權(quán)擔(dān)保制度之一。目前,我國的海事留置權(quán)制度尚處于發(fā)展和完善階段,并且大多數(shù)學(xué)者都是對海事留置權(quán)制度中的各類留置權(quán)單獨(dú)進(jìn)行研究,這樣很不利于海事留置權(quán)制度的整體發(fā)展和研究。鑒于此,本文對我國的海事留置權(quán)制度的現(xiàn)狀進(jìn)行了系統(tǒng)地總結(jié),并根據(jù)民法留置擔(dān)保的原理,針對海事法律關(guān)系的特點(diǎn),從以下幾個(gè)方面對海事留置權(quán)制度進(jìn)行了較詳細(xì)地研究和分析: 除前言外,本文共分六章。 第一章簡要論述了留置權(quán)的一般概念、特點(diǎn)及我國海事留置權(quán)的概念、分類和特點(diǎn),并從總體上對我國《海商法》所規(guī)定的留置權(quán)作了一個(gè)扼要的說明。 第二章闡述了船舶留置權(quán)的概念、特征、取得、效力、實(shí)現(xiàn)、消滅,并分析了與船舶留置權(quán)易混淆的各種權(quán)利。 第三章論述了承拖方留置權(quán)的概念、特征及效力,并與海難救助方留置權(quán)做了比較。 第四章概述了海難救助方留置權(quán),且詳細(xì)分析了其主體、標(biāo)的及內(nèi)容,并與打撈方留置權(quán)進(jìn)行了對比。 第五章對海上貨物留置權(quán)的概念、行使方式、效力進(jìn)行全面論述,并特別分析了無船承運(yùn)人的留置權(quán)以及對集裝箱貨物行使留置權(quán)的特殊性。 第六章對租船合同中的留置權(quán)進(jìn)行了分析和闡述,其中主要論述了航次租船合同中的責(zé)任中止條款及定期租船合同中出租人對轉(zhuǎn)租船舶收入留置權(quán)的性質(zhì)和行使方法。
[Abstract]:Maritime lien system is a lien system applicable to maritime legal relations. It is different from the general lien system in civil law. It is an important legal system in the field of maritime law, and also one of the security systems of maritime interest. At present, the maritime lien system in our country is still in the stage of development and perfection, and most scholars have studied all kinds of liens in the maritime lien system separately, which is not conducive to the overall development and research of maritime lien system. In view of this, this paper systematically summarizes the present situation of maritime lien system in our country, and according to the principle of civil law lien, aiming at the characteristics of maritime legal relationship, This paper makes a detailed study and analysis of maritime lien system from the following aspects: apart from the preface, this paper is divided into six chapters. The first chapter briefly discusses the general concept of lien, its characteristics, the concept, classification and characteristics of maritime lien in China, and gives a brief explanation of the lien stipulated in Maritime Law of our country as a whole. The second chapter describes the concept, characteristics, acquisition, effectiveness, realization and elimination of the ship lien, and analyzes the various rights easily confused with the ship lien. The third chapter discusses the concept, characteristics and effectiveness of towing lien, and makes a comparison with salvage lien. Chapter four summarizes the lien of salvage party, analyzes its subject, object and content in detail, and compares it with salvage lien. In the fifth chapter, the concept, mode and effect of the lien on the sea cargo are discussed, and the particularity of the lien of the non-ship carrier and the enforcement of the lien on the container cargo is analyzed in particular. The sixth chapter analyzes and expounds the lien in the charter party, which mainly discusses the discontinuance clause of the voyage charter party and the nature and method of the shipowner's lien on the income of the subchartered ship in the term charter contract.
