我國船舶登記制度及其實踐法律問題研究

【摘要】: 船舶登記關乎船舶的基本存在,其對國家航運經(jīng)濟發(fā)展、航運企業(yè)經(jīng)營收益,乃至個人財產(chǎn)利益的影響不言而喻。我國是國際上的航運大國,船舶登記在支持、配合航運經(jīng)濟乃至國家總體經(jīng)濟發(fā)展,規(guī)范、維護航運市場健康成長方面更是起著舉足輕重的作用。 船舶的人格化以及其具有的不動產(chǎn)性,決定了船舶很多權利需要靠登記來生效、產(chǎn)生對抗。船舶登記的分類方法和由此產(chǎn)生的種類很多,各自有著不同的作用和意義,從船舶登記獲得的權利看,對船舶物權(所有權、抵押權、光船租賃)和船舶國籍(航行權)的確認是船舶登記的主要作用!逗I谭ā泛1994年生效的《中華人民共和國船舶登記條例》是我國船舶登記方面主要的法律依據(jù)。我國目前采用單一的嚴格船舶登記制度,和國外其他航運國家做法不盡相同,各有利弊。通過中外船舶登記制度和實踐做法的對比,結合近年來我國船舶登記實踐中遇到的實際問題,筆者認為我國現(xiàn)行的單一的船舶登記制度已不能完全適應國內(nèi)航運業(yè)發(fā)展需要,船舶登記的法律依據(jù)相互重疊、矛盾現(xiàn)象突出,我國船舶登記機關──海事局在登記工作中法律責任定位不明等是我國船舶登記亟待改進、完善的主要方面。 為此,筆者以促進我國航運市場發(fā)展、明確船舶登記法律依據(jù)、規(guī)范船舶登記做法為目的,對上述我國船舶登記中存在的問題進行原因分析和理論研究,嘗試著提出在國內(nèi)設立"第二船籍登記"、盡快修訂《船舶登記條例》、將船舶登記定位為形式審查,在相關法律法規(guī)中明確登記機關法律責任等解決問題的思路和方法,為下一步變革登記制度,修改相關法律、法規(guī)提供建設性意見和可行性方案。
[Abstract]:Ship registration is related to the basic existence of ships, and its influence on the development of national shipping economy, the operating income of shipping enterprises and even the interests of personal property is self-evident. China is a big shipping country in the world, and ship registration plays an important role in supporting, cooperating with the development of shipping economy and even in the overall economic development of the country, standardizing and maintaining the healthy growth of shipping market. The personalization and immovable property of the ship determine that many rights of the ship need to be registered to take effect and produce confrontation. There are many classification methods and kinds of ship registration, each of which has different functions and meanings. From the point of view of the rights obtained from ship registration, the real right of ship (ownership, mortgage), The maritime law and the regulations of the people's Republic of China, which came into effect in 1994, are the main legal bases for the registration of ships in China. At present, our country adopts a single strict ship registration system, which is different from other shipping countries in foreign countries and has its own advantages and disadvantages. Through the comparison between Chinese and foreign ship registration system and practice, combined with the practical problems encountered in China's ship registration practice in recent years, the author thinks that the current single ship registration system in our country can no longer fully meet the needs of the development of domestic shipping industry. The legal basis of ship registration overlaps with each other, and the contradictory phenomenon is prominent. The ship registration authority of our country-the legal responsibility of the maritime affairs bureau in the registration work is not clear, etc.-is the main aspect of the ship registration in our country that needs to be improved and perfected urgently Therefore, in order to promote the development of shipping market in our country, make clear the legal basis of ship registration and standardize the practice of ship registration, the author analyzes the reasons and theoretical research on the problems existing in the above mentioned ship registration in our country. This paper tries to put forward some ideas and methods to solve the problems, such as setting up the "second registry" in China, amending the ship Registration regulations as soon as possible, positioning the ship registration as a formal examination, and making clear the legal responsibility of the registration authority in the relevant laws and regulations. Provide constructive advice and feasible plan for the next step to change the registration system, amend the relevant laws and regulations.
