【摘要】：美國《統(tǒng)一商法典》流通票據(jù)編具有許多特色,包括:1.正當持票人制度以保護善意對價持票人為核心,促進票據(jù)的自由流通;2.融通票據(jù)將票據(jù)的信用功能發(fā)揮到極致,融通當事人和被融通當事人之間僅存在信用的授受;3.創(chuàng)設(shè)了相對獨特的背書偽造風(fēng)險責(zé)任制度。我國票據(jù)法可借鑒上述合理成分,完善相關(guān)立法。
[Abstract]:The uniform Commercial Code of the United States has many characteristics, including: 1. The proper bearer system takes the protection of bona fide bearer as the core to promote the free circulation of the bill. 2. The paper brings the credit function of the bill into full play, and there is only the granting of credit between the party concerned and the party who has been financed; 3. Has created the relatively unique endorsement forgery risk responsibility system. Our country negotiable instrument law may draw lessons from the above reasonable ingredient, consummates the related legislation.
