【摘要】： 在中國,隨著經(jīng)濟(jì)體制改革的步履維艱,關(guān)乎國運(yùn)、惠及子孫的社會(huì)保障改革和社會(huì)保障法制建設(shè)也越來越被人們所認(rèn)識(shí)。但由于長(zhǎng)期以來,社會(huì)保障法沒有被作為一個(gè)獨(dú)立的法律部門提出來進(jìn)行研究和建設(shè),社會(huì)保障法學(xué)的研究遠(yuǎn)遠(yuǎn)地落后于民商法、經(jīng)濟(jì)法、勞動(dòng)法等法律部門,顯然不能適應(yīng)社會(huì)保障制度化、法律化的要求�，F(xiàn)有的研究?jī)H限于對(duì)社會(huì)保障改革的熱點(diǎn)問題提出立法建議和設(shè)想,或就一些社會(huì)保障法律問題進(jìn)行初步的探討、研究,還停留在初步階段上,更勿論對(duì)歷史到現(xiàn)實(shí)的法制道路的深入研究。但是如果不對(duì)社會(huì)保障法制進(jìn)行歷史反思和理性思考,我們就無法對(duì)社會(huì)保障法制的經(jīng)濟(jì)、政治、文化的底蘊(yùn)作出深刻的透視,更不能奢談建設(shè)有中國特色的社會(huì)保障法制�；诖苏J(rèn)識(shí),本論文從法制史學(xué)角度運(yùn)用制度分析的方法、歷史的方法和綜合的方法對(duì)中國社會(huì)保障法制進(jìn)行研究,以便對(duì)中國社會(huì)保障法制現(xiàn)代化進(jìn)程中諸如歷史根源、動(dòng)力與障礙、基本規(guī)律、發(fā)展趨勢(shì)等給予實(shí)務(wù)上的揭示和理論上的說明。 全文由導(dǎo)論、第一至第五章及結(jié)論組成。 本論文認(rèn)為我國在社會(huì)保障模式的選擇上,因社會(huì)制度、人口眾多、國力有限、地區(qū)發(fā)展不平衡等國情,以及家庭承擔(dān)養(yǎng)老哺幼責(zé)任的民族傳統(tǒng),決定了我國不可能照搬西方的現(xiàn)代模式,我們既需要借鑒國外社會(huì)保障法制建設(shè)的經(jīng)驗(yàn)教訓(xùn),更需要在充分尊重國情傳統(tǒng)的基礎(chǔ)上走中國自己特色的道路。
[Abstract]:In China, with the difficulty of economic system reform, the social security reform and the construction of social security legal system, which benefit the future generations, are more and more recognized by people. However, for a long time, the social security law has not been proposed as an independent legal department for research and construction. The study of social security law has lagged far behind the civil and commercial law, economic law, labor law and other legal departments. Obviously cannot adapt to the social security systematization, the legalization request. The existing studies are limited to putting forward legislative suggestions and ideas on the hot issues of social security reform, or carrying out preliminary discussions on some legal issues of social security. The study is still at the initial stage. Not to mention the in-depth study of the legal system from history to reality. However, if we do not reflect on the legal system of social security in history and think rationally, we will not be able to make a profound perspective on the economic, political and cultural background of the legal system of social security, let alone talk about the construction of the legal system of social security with Chinese characteristics. Based on this understanding, this paper uses the method of system analysis, the method of history and the comprehensive method to study the legal system of social security in China from the angle of legal history, in order to study the historical origin of the modernization of legal system of social security in China. Motive force and obstacle, basic law, development trend and so on give the practical revelation and the theory explanation. The full text consists of introduction, chapters 1 to 5 and conclusion. This paper believes that the choice of social security model in China, because of the social system, large population, limited national strength, uneven regional development, and the national tradition that families bear the responsibility of providing for the aged and feeding the children. It is decided that our country can not copy the western modern mode. We need to learn from the experience and lessons of the construction of the legal system of social security in foreign countries, and we also need to take the road of China's own characteristics on the basis of fully respecting the tradition of the national conditions.
