【摘要】： 船舶溢油事故是造成海洋環(huán)境污染的重要途徑。二十世紀(jì)以來，海洋環(huán)境污染和生態(tài)破壞日益突出，成為全球性的重大問題。隨著環(huán)境保護(hù)意識的不斷增強(qiáng)，各國保護(hù)海洋環(huán)境的立法層出不窮，，調(diào)整船舶油污損害賠償?shù)膰鴥?nèi)法以及國際公約應(yīng)運(yùn)而生。我國船舶油污損害賠償問題也越來越受到關(guān)注，已成為重要的研究課題。 本文介紹了船舶油污損害賠償?shù)幕A(chǔ)理論，分析了船舶油污損害賠償?shù)母拍睢⑻攸c(diǎn)以及歸責(zé)原則，討論了船舶油污損害賠償?shù)姆审w系、賠償范圍，研究了船舶油污強(qiáng)制保險(xiǎn)制度、責(zé)任限制制度以及油污損害賠償基金制度。本文重點(diǎn)論述了建立我國船舶油污損害賠償機(jī)制的主要法律問題以及建立我國國內(nèi)船舶油污損害賠償基金的管理模式、制度設(shè)計(jì)等具體內(nèi)容，并提出有關(guān)立法建議。建立我國船舶油污損害賠償機(jī)制，不僅能夠使油污事故的受害人得到及時、充分的賠償，而且為海洋環(huán)境的恢復(fù)工作和可持續(xù)發(fā)展提供了資金保證，具有十分重要的意義。 由于我國尚沒有關(guān)于船舶油污損害方面的專門立法，缺乏完善的船舶油污損害賠償機(jī)制，加快我國船舶油污損害賠償立法的進(jìn)程，建立健全我國船舶油污損害賠償機(jī)制是十分必要和緊迫的。文章建議通過立法對國內(nèi)沿海運(yùn)輸船舶實(shí)行油污強(qiáng)制保險(xiǎn)，并對責(zé)任限制給予明確規(guī)定。同時，借鑒國際油污基金的運(yùn)作模式和管理經(jīng)驗(yàn)來構(gòu)建符合我國國情的國內(nèi)油污損害賠償基金制度，最終實(shí)現(xiàn)與國際接軌。
[Abstract]:Ship oil spill accident is an important way to cause marine environmental pollution. Since the 20th century, marine environmental pollution and ecological destruction have become increasingly prominent, becoming a major global problem. With the increasing consciousness of environmental protection, the legislation of protecting marine environment is emerging in various countries, and the domestic laws and international conventions to adjust the compensation for oil pollution damage of ships emerge as the times require. More and more attention has been paid to the compensation of oil pollution damage from ships in China, which has become an important research topic. This paper introduces the basic theory of ship oil pollution damage compensation, analyzes the concept, characteristics and imputation principle of ship oil pollution damage compensation, and discusses the legal system and compensation scope of ship oil pollution damage compensation. The compulsory insurance system, liability limitation system and oil pollution compensation fund system are studied. This paper focuses on the main legal problems of establishing the compensation mechanism for oil pollution damage from ships in China, the management mode and system design of the compensation fund for oil pollution damage caused by ships in China, and puts forward some legislative suggestions. The establishment of compensation mechanism for oil pollution damage of ships in our country can not only make the victims of oil pollution accidents receive timely and adequate compensation, but also provide financial guarantee for the restoration and sustainable development of marine environment, which is of great significance. There is no special legislation on ship oil pollution damage in our country, and there is no perfect compensation mechanism for ship oil pollution damage, so as to speed up the legislation process of ship oil pollution damage compensation in our country. It is necessary and urgent to establish and perfect the compensation mechanism for oil pollution damage from ships in China. In this paper, it is suggested that compulsory oil pollution insurance be carried out on domestic coastal transport vessels through legislation, and the limitation of liability should be clearly stipulated. At the same time, draw lessons from the operation mode and management experience of the international oil pollution fund to construct the domestic oil pollution damage compensation fund system in accordance with the national conditions of our country, and finally realize the international integration.
