【摘要】：交易安全意指移轉(zhuǎn)財(cái)產(chǎn)權(quán)利和履行財(cái)產(chǎn)義務(wù)的行為之合法性與確定性，其實(shí)質(zhì)是對(duì)交易中善意無(wú)過(guò)失者之保護(hù)。它具有公正、效益和秩序之價(jià)值。世界范圍內(nèi)的民商法發(fā)展史，經(jīng)歷了“由靜到動(dòng)”的過(guò)程，，即由強(qiáng)調(diào)對(duì)財(cái)產(chǎn)靜態(tài)權(quán)屬關(guān)系的確認(rèn)和維護(hù)演繹為對(duì)交易安全的尊重和保障，交易安全已成為現(xiàn)代民商法的重要價(jià)值關(guān)懷。中國(guó)民商法對(duì)交易安全之保護(hù)相對(duì)滯后，強(qiáng)化交易安全為中國(guó)民商法現(xiàn)代化的重要使命，而具體措施主要在于建立物權(quán)公示制度，變革完善法律行為與意思表示制度、自然人行為能力制度和法人權(quán)利能力（行為能力）制度以及完善代理制度幾個(gè)方面。
[Abstract]:Transaction security refers to the legality and certainty of the transfer of property rights and the performance of property obligations, the essence of which is to protect the bona fide and no-fault persons in the transaction. It has the value of justice, efficiency and order. The history of the development of civil and commercial law in the world has gone through the process of "from static to dynamic", that is, from emphasizing the recognition and maintenance of the static property ownership relationship to the respect and guarantee of transaction security. Transaction security has become an important value concern of modern civil and commercial law. The protection of transaction security in China's civil and commercial law is relatively lagging behind. Strengthening the security of transactions is an important mission for the modernization of Chinese civil and commercial law. The concrete measures are mainly to establish a system of publicizing property rights and to reform and perfect the system of legal acts and expressions of will. The system of natural person's capacity for conduct and legal person's capacity of right (capacity of conduct) and the perfection of agency system.
