海上人身傷亡賠償制度研究

【摘要】:本文所探討的海上人身傷亡損害賠償是指權(quán)利人在海上、與海相 通的可航水域或與海密切相關(guān)的特定處所的經(jīng)營、管理或服務(wù)活動中 生命權(quán)、健康權(quán)受到損害,由責(zé)任人給予賠償?shù)姆芍贫。按照不?當(dāng)事人之間各自的法律關(guān)系,責(zé)任人承擔(dān)賠償責(zé)任的基礎(chǔ)和依據(jù)各 異。 在本文的探討過程中,筆者并未囿于對《海商法》的偏愛,而是 對涉及海上人身傷亡賠償?shù)姆、法?guī)和規(guī)章及司法解釋都作系統(tǒng)的 分析,尤其注重運(yùn)用民法基本原理分析海上人身傷亡賠償?shù)奶貏e問 題。筆者從賠償原則、歸責(zé)原則、責(zé)任基礎(chǔ)、責(zé)任限制、賠償范圍與 標(biāo)準(zhǔn)、精神損害賠償?shù)确矫嫒胧?對海上人身傷亡賠償作全面分析與 探討。 筆者通過對現(xiàn)有法律的疏理與思考,指出其存在的缺陷與不足, 并大膽提出自己的建議,如推動海上人身傷亡賠償?shù)奶貏e立法,實(shí)行 強(qiáng)制責(zé)任保險(xiǎn)制度,擯棄勞動仲裁前置原則,采用差額救濟(jì)模式處理 工傷賠償。筆者期望本文的探討與建議能有助于海上人身傷亡賠償制 度的發(fā)展與完善。
[Abstract]:The compensation for personal injury and injury at sea discussed in this paper refers to the operation of the right holder at sea, navigable waters connected with the sea or specific places closely related to the sea. The legal system in which the right to life and the right to health are impaired and compensated by those responsible in the administration or service. According to the legal relationship between different parties, the liability of the responsible person is different. In the course of the discussion, the author is not confined to the preference of Maritime Law, but to the law of compensation for personal injury and death at sea. Laws and regulations and judicial interpretations are systematically analysed, Especially pay attention to apply the basic principles of civil law to analyze the special question of maritime personal injury and injury compensation. The author starts with the principle of compensation, the principle of liability, the basis of liability, the limitation of liability, the scope and standard of compensation, the compensation for mental damage, etc. This paper makes a comprehensive analysis and discussion on the compensation for personal injury and death at sea. The author points out the defects and shortcomings of the existing laws, and puts forward his own suggestions, such as promoting special legislation for compensation for personal injury and death at sea. The compulsory liability insurance system is implemented, the principle of labor arbitration is abandoned, and the compensation for industrial injury is dealt with by the mode of differential relief. The author hopes that the discussion and suggestions in this paper will be helpful to the development and perfection of marine personal injury compensation system.
