【摘要】：現(xiàn)代商會(huì)作為一種“保商”、“振商”的利器,游走于政府與市場(chǎng)之間,發(fā)揮著獨(dú)特的作用。基于商會(huì)法律制度的不健全、商會(huì)與政府之間關(guān)系的難分難解、商會(huì)內(nèi)部機(jī)構(gòu)的不合理設(shè)置等問(wèn)題,我國(guó)商會(huì)治理改革的緊迫性已無(wú)需更多的論證和分析,目前國(guó)內(nèi)無(wú)論是立法界還是實(shí)務(wù)界、理論界,最缺乏的即為從實(shí)踐出發(fā),研究商會(huì)治理過(guò)程中面臨的各類問(wèn)題,并在此基礎(chǔ)上提出合理有效的建議。 本文擬以實(shí)踐中商會(huì)為例,通過(guò)比較分析法、邏輯分析法、規(guī)范分析法、實(shí)證分析法等研究方法,比較整合商會(huì)章程的基本內(nèi)容,全面考察商會(huì)治理的特征、治理現(xiàn)狀、以及實(shí)踐中商會(huì)治理面臨的問(wèn)題,通過(guò)考察和梳理商會(huì)組織機(jī)構(gòu)的設(shè)置、運(yùn)行模式及商會(huì)的治理機(jī)制,結(jié)合英美法德等國(guó)的先進(jìn)治理經(jīng)驗(yàn),對(duì)完善我國(guó)商會(huì)治理機(jī)制提出合理建議。 本文認(rèn)為,基于目前我國(guó)商會(huì)治理面臨的困境,宜結(jié)合國(guó)外商會(huì)先進(jìn)的治理理念,從細(xì)化商會(huì)章程的內(nèi)容、合理設(shè)置商會(huì)內(nèi)部機(jī)構(gòu)、優(yōu)化商會(huì)內(nèi)部的運(yùn)行機(jī)制(包括決策機(jī)制、激勵(lì)機(jī)制、監(jiān)督機(jī)制、人才機(jī)制、財(cái)務(wù)機(jī)制等內(nèi)容)、以及完善商會(huì)立法和有關(guān)商會(huì)的行政管理制度等方面入手,切實(shí)解決我國(guó)商會(huì)治理面臨的實(shí)際問(wèn)題。如此,“內(nèi)外結(jié)合,標(biāo)本兼治”必將令我國(guó)商會(huì)邁向欣欣向榮的未來(lái)。
[Abstract]:Modern Chamber of Commerce, as a sharp weapon of "protecting merchants" and "vibrating quotient", walks between the government and the market and plays a unique role. Due to the unsound legal system of the Chamber of Commerce, the inextricable relationship between the Chamber of Commerce and the government, and the unreasonable establishment of the internal organs of the Chamber of Commerce, the urgency of the reform of the governance of the Chamber of Commerce in our country no longer needs more argumentation and analysis. At present, what is most lacking in the domestic legislative, practical and theoretical circles is to study all kinds of problems faced by the Chamber of Commerce in the process of governance from the point of view of practice, and put forward reasonable and effective suggestions on this basis. In this paper, the Chamber of Commerce in practice as an example, through comparative analysis, logic analysis, normative analysis, empirical analysis and other research methods, comparative integration of the basic content of the Chamber of Commerce charter, comprehensive investigation of the characteristics of the Chamber of Commerce governance, governance status, As well as the problems faced by the Chamber of Commerce in practice, by examining and combing the organization and organization of the Chamber of Commerce, the operating mode and the governing mechanism of the Chamber of Commerce, and combining the advanced governance experience of the Anglo-American, French, German and other countries, To perfect our country chamber of commerce to manage mechanism to put forward reasonable proposal. This paper holds that, based on the difficulties that China's chamber of commerce is facing in governing, it is advisable to combine the advanced governance ideas of foreign chambers of commerce, from the refinement of the contents of the chamber's charter, to rationally set up the internal organization of the chamber of commerce, and to optimize the internal operating mechanism (including decision-making mechanism) of the chamber of commerce. Incentive mechanism, supervision mechanism, talent mechanism, financial mechanism and so on), as well as consummates the chamber of commerce legislation and the related chamber of commerce administration management system and so on, solves the actual problem that our country chamber of commerce manages to face conscientiously. In this way, the combination of internal and external, the treatment of both symptoms and symptoms will lead to a prosperous future for China's chambers of commerce.
