【摘要】： 國(guó)際貨物多式聯(lián)運(yùn)在世界經(jīng)濟(jì)發(fā)展中的地位越來越重要，對(duì)于我國(guó)這樣一個(gè)發(fā)展中國(guó)家而言更是如此。自國(guó)際貨物多式聯(lián)運(yùn)誕生以來就一直呼喚著聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度的法律統(tǒng)一，然而至今仍然沒有一部具有法律效力的國(guó)際貨物多式聯(lián)運(yùn)公約，這極大的制約了貨物多式聯(lián)運(yùn)以及國(guó)際貿(mào)易的發(fā)展。我國(guó)有關(guān)國(guó)際貨物多式聯(lián)運(yùn)的法律同樣不能很好的滿足多式聯(lián)運(yùn)業(yè)發(fā)展的需要，亟待完善和發(fā)展。 本文從傳統(tǒng)民商法的基本原理出發(fā)，對(duì)世界各國(guó)和地區(qū)相關(guān)法律制度以及現(xiàn)有公約與規(guī)則采用比較分析的方法，同時(shí)合理借鑒法律經(jīng)濟(jì)學(xué)的相關(guān)理論和觀點(diǎn)，對(duì)國(guó)際貨物多式聯(lián)運(yùn)予以界定，對(duì)國(guó)際貨物多式聯(lián)運(yùn)經(jīng)營(yíng)人與貨運(yùn)代理人、港站經(jīng)營(yíng)人的法律地位，他們之間以及他們與貨物利益方之間的權(quán)利義務(wù)關(guān)系進(jìn)行分析，并在此基礎(chǔ)上著重對(duì)貨物多式聯(lián)運(yùn)的核心法律問題，，即多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度進(jìn)行研究，并對(duì)國(guó)際貨物多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度的統(tǒng)一進(jìn)行探討，最后本文提出我國(guó)多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度的初步法律框架，希望能對(duì)國(guó)際以及我國(guó)多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任制度的研究和完善有所助益。
[Abstract]:International multimodal transport of goods plays an increasingly important role in the development of world economy, especially for a developing country like China. Since the birth of international multimodal transport of goods, it has been calling for the unification of the law of the liability system of intermodal transport operators. However, there is still no international convention on multimodal transport of goods with legal effect. This greatly restricted the development of multimodal transport of goods and international trade. The law on international multimodal transport of goods in our country can not meet the needs of the development of multimodal transport industry, so it needs to be perfected and developed. Based on the basic principles of traditional civil and commercial law, this paper adopts a comparative analysis of the relevant legal systems and existing conventions and rules of various countries and regions in the world, and at the same time, reasonably draws lessons from the relevant theories and viewpoints of law and economics. Definition of international multimodal transport of goods, analysis of the legal status of international cargo multimodal transport operators and freight forwarders, the legal status of operators at port stations, their rights and obligations as well as the relationship between them and the parties to the goods, On this basis, the core legal issues of multimodal transport of goods, namely, the liability system of multimodal transport operators, are emphatically studied, and the unification of the liability system of international multimodal transport of goods is discussed. Finally, this paper puts forward the preliminary legal framework of the liability system of multimodal transport operators in China, hoping to be helpful to the research and improvement of international and Chinese multimodal transport operators' liability system.
