【摘要】：海上危險貨物運輸是海上運輸領域的一個重要組成部分。目前,無論是理論方面,還是實務操作方面,海上危險貨物運輸都顯現(xiàn)出其與眾不同之處,這已經成為海商法理論界和航運界研究的熱點問題。 本文從海上危險貨物運輸?shù)奶攸c入手,運用比較分析、實證分析等研究方法,結合海商法和民法的基本理論,并借鑒國際公約、UNCITRAL最新運輸法公約草案、航運發(fā)達國家的先進立法及英美法系國家的權威判例,著重對危險貨物的界定、海上危險貨物運輸立法的現(xiàn)狀及發(fā)展趨勢、危險貨物托運人的法律地位、危險貨物承運人的法律地位這幾個問題進行系統(tǒng)闡述,分析了我國現(xiàn)行立法的不足,進而提出了一些具體的法律修改建議。同時,本文針對危險貨物托運人向承運人履行法定告知義務、托運人違反告知義務應承擔的責任以及危險貨物承運人拒絕運輸權、危險貨物處置權等特殊問題進行了重點分析,期望能夠對促進海上危險貨物運輸業(yè)的發(fā)展及海事立法的完善有所裨益。 本文通過研究認為,為完善我國海上危險貨物運輸法律制度,必須遵循海上危險貨物運輸立法的發(fā)展趨勢,對危險貨物作出一個清晰的界定,建立海上危險貨物運輸合同當事人資質許可制度,進一步明確危險貨物承托雙方的法律地位,對各自的權利、義務和責任作出詳細規(guī)定,使之更趨于合理化,以保障海上危險貨物運輸安全,促進海上危險貨物運輸?shù)牧夹�、健康發(fā)展。
[Abstract]:The transport of dangerous goods by sea is an important part in the field of maritime transport. At present, whether in theory or in practice, the transport of dangerous goods by sea shows its differences, which has become a hot issue in the field of maritime law theory and shipping. This paper starts with the characteristics of the carriage of dangerous goods by sea, applies comparative analysis, empirical analysis and other research methods, combines the basic theories of maritime law and civil law, and draws lessons from the latest draft UNCITRAL Convention on Transport Law. The advanced legislation of shipping developed countries and the authoritative precedents of Anglo-American legal system countries focus on the definition of dangerous goods, the current situation and development trend of legislation on the carriage of dangerous goods by sea, and the legal status of shippers of dangerous goods. The problems of the legal status of the carrier of dangerous goods are systematically expounded, the deficiencies of the current legislation in our country are analyzed, and some specific suggestions for amending the law are put forward. At the same time, this paper focuses on the special problems, such as the shipper of dangerous goods to fulfill the legal obligation of notification to the carrier, the liability of the shipper for breach of the obligation of notification, the right of the carrier of dangerous goods to refuse to transport, the right to dispose of dangerous goods, and so on. It is expected to promote the development of the maritime dangerous goods transportation industry and the improvement of maritime legislation. In this paper, the author thinks that in order to perfect the legal system of maritime transport of dangerous goods in China, we must follow the developing trend of legislation on the carriage of dangerous goods by sea, and make a clear definition of dangerous goods. To establish a system of qualification permits for the parties to a contract for the carriage of dangerous goods by sea, to further clarify the legal status of both parties to the transport of dangerous goods, and to make detailed provisions on their respective rights, obligations and responsibilities, so as to make them more reasonable, In order to ensure the safety of maritime transport of dangerous goods, to promote the sound and healthy development of maritime transport of dangerous goods.
