【摘要】：貨幣所有權(quán)問(wèn)題不僅涉及民法上財(cái)產(chǎn)所有權(quán)靜的安全與財(cái)產(chǎn)交易的動(dòng)的安全保護(hù)問(wèn)題,也涉及商法、經(jīng)濟(jì)法、刑法等諸多法律門(mén)類(lèi),目前學(xué)界主流觀點(diǎn)將貨幣所有權(quán)流轉(zhuǎn)規(guī)則確定為"占有即所有",既不符合貨幣自身特點(diǎn),也不符合相關(guān)法學(xué)理論一般認(rèn)知。因此應(yīng)當(dāng)重新對(duì)貨幣進(jìn)行審視、分析后再行確定。
[Abstract]:The problem of monetary ownership involves not only the security of property ownership in civil law and the security protection of property transaction, but also the commercial law, economic law, criminal law and many other legal categories, such as commercial law, economic law, criminal law and so on. At present, the mainstream view of academic circles determines the rule of money ownership circulation as "possession is all", which does not accord with the characteristics of money itself, nor with the general cognition of relevant legal theories. Therefore, the currency should be re-examined, and then determined after analysis.
