略論承運人的過失免責

【摘要】:正 承運人的過失免責,是指承運人對引航員、船長、船員以及船公司雇傭的其他人在駕駛或管理船舶方面的過失或疏忽所造成的貨物滅失或損害可以免除賠償責任。因此,它只是相對于船長、船員、引航員或承運人的雇傭人員在駕駛或管理船舶上的行為、疏忽造或不履行契約而言的,如果是因管理貨物上的過失所致的損失,承運人是不能免責的。目前在進出口貿(mào)易中,70—80%的契約都是通過海上運輸這種方式完成的,因此,明確承運人的過失免責、范圍及其適用條件,對于劃清承運人與保險人之間的責任,保護收貨人的合法權(quán)益,具有十分重要的意義。免責事項可分為兩大類,一是過失免責,一是無過失免責。我國《海商法》第51條規(guī)定,在責任期間內(nèi)因船長、
