船舶優(yōu)先權(quán)若干法律問題的研究

【摘要】: 船舶優(yōu)先權(quán)是海商法特有的一項(xiàng)法律制度,但是由于各國的基本法律制度存在差異,因此在船舶優(yōu)先權(quán)的行使過程中亦存在著沖突。在我國,《海商法》頒布的時(shí)間較晚,因而關(guān)于船舶優(yōu)先權(quán)的理論研究相對來說不夠成熟,在實(shí)踐中經(jīng)常出現(xiàn)歧義,為司法上的統(tǒng)一帶來若干困難。本文將結(jié)合國際法及我國的有關(guān)法律規(guī)定,,從司法實(shí)踐中存在的一些問題出發(fā),對船舶優(yōu)先權(quán)制度的相關(guān)問題作一論述。 首先,本文對船舶優(yōu)先權(quán)的產(chǎn)生、發(fā)展及現(xiàn)狀作一論述,然后結(jié)合民商法中的物權(quán)法及擔(dān)保法的有關(guān)規(guī)定,論證船舶優(yōu)先權(quán)的性質(zhì)是一種擔(dān)保物權(quán),在此基礎(chǔ)上,總結(jié)出船舶優(yōu)先權(quán)的特征;其次,對船舶優(yōu)先權(quán)的內(nèi)容作一論述。本章分三節(jié),分別對船舶優(yōu)先權(quán)的標(biāo)的、項(xiàng)目和受償順序以及船舶優(yōu)先權(quán)消滅的原因進(jìn)行論述。在該章中,將結(jié)合國際公約、其他海運(yùn)國家的相關(guān)法律規(guī)定以及部分案例,對我國船舶優(yōu)先權(quán)的立法進(jìn)行評述,并提出自己的見解。該部分是從理論上對船舶優(yōu)先權(quán)進(jìn)行探討;第三,結(jié)合上述理論探討,對船舶優(yōu)先權(quán)行使過程中遇到的一些問題進(jìn)行闡述。本章主要對司法實(shí)踐中爭議較多的船員工資優(yōu)先權(quán)的主體、所有權(quán)變更下,船舶優(yōu)先權(quán)的行使與訴訟的關(guān)系、船舶優(yōu)先權(quán)的行使與扣船的關(guān)系以及船舶優(yōu)先權(quán)的行使與海事賠償責(zé)任限制的關(guān)系四個(gè)問題加以闡述。在該部分中,將結(jié)合不同的學(xué)術(shù)觀點(diǎn)及有關(guān)案例進(jìn)行分析,從而提出解決問題的思路。該部分是從實(shí)踐上對船舶優(yōu)先權(quán)的探討;最后,總結(jié)全文,說明研究船舶優(yōu)先權(quán)制度的重要意義。
[Abstract]:Maritime lien is a unique legal system of maritime law. However, because of the differences in the basic legal system of countries, there are conflicts in the exercise of maritime lien. In our country, the time of the promulgation of maritime law is relatively late. Therefore, the theoretical research on maritime lien is not mature enough and is often found in practice. The present ambiguity brings some difficulties to the unification of the judiciary. This article will discuss the problems related to the system of maritime lien in accordance with the international law and the relevant legal provisions of our country and from some of the problems that exist in the judicial practice.
First, this article discusses the production, development and present situation of the maritime lien. Then, combining the relevant provisions of the property law and the guarantee law in the civil and commercial law, it is demonstrated that the nature of the maritime lien is a kind of security right. On this basis, the characteristics of the maritime lien are summed up. Secondly, the contents of the maritime lien are discussed. This chapter is divided into three sections. In this chapter, the article reviews the legislation of China's maritime lien and puts forward its own opinions in this chapter, which is theoretically based on the theory of the ship. On the basis of the above theory, third, some problems encountered in the process of the exercise of maritime lien are discussed. This chapter mainly focuses on the main body of the wage priority of the crew in the judicial practice, the relationship between the exercise of the maritime liens and the litigation, the exercise of the priority of the ship and the buckle of the ship. The relationship between four problems and the relationship between the exercise of maritime lien and the limitation of maritime liability is expounded. In this part, it will be analyzed with different academic views and related cases, so as to put forward the idea of solving the problem. This part is a discussion of the Maritime Liens in practice; finally, the full text is summarized to explain the research ship. The importance of the ship's priority system.
