【摘要】： 在民事訴訟實(shí)踐中，雙方當(dāng)事人的舉證責(zé)任的分配基本是依據(jù)“誰(shuí)主張，誰(shuí)舉證”這一《民事訴訟法》中規(guī)定的舉證責(zé)任的分配規(guī)則，但是，保險(xiǎn)是與過(guò)錯(cuò)民事責(zé)任無(wú)關(guān)的經(jīng)濟(jì)補(bǔ)償制度，所以在海上保險(xiǎn)訴訟中如完全依照“誰(shuí)主張，誰(shuí)舉證”去分配當(dāng)事人的舉證責(zé)任，勢(shì)必就會(huì)造成違背《海商法》中有關(guān)海上保險(xiǎn)的立法本意，為此，在我國(guó)還沒(méi)有證據(jù)法的客觀條件下，本文簡(jiǎn)短地介紹了舉證責(zé)任的基本概念、舉證責(zé)任分配規(guī)則的源流及早期學(xué)說(shuō)，然后是對(duì)舉證責(zé)任分配理論新的發(fā)展趨勢(shì)的探討。 總之，，本文立足于舉證責(zé)任配置的根本宗旨在于維護(hù)法律的公平和正義，參照各家學(xué)說(shuō)和理論，全面地探討了海上保險(xiǎn)中舉證責(zé)任的分配問(wèn)題，初步地構(gòu)建出我國(guó)海上保險(xiǎn)的舉證責(zé)任的分配規(guī)則體系。
[Abstract]:In the practice of civil procedure, the distribution of the burden of proof of both parties is basically based on the rules of allocation of the burden of proof stipulated in the Code of Civil procedure. Insurance is an economic compensation system that has nothing to do with civil liability for fault. Therefore, in marine insurance proceedings, if the burden of proof is assigned to the parties in accordance with "who claims, who proves", It is bound to cause the violation of the legislative intent of maritime insurance in Maritime Law. Therefore, under the objective condition that there is no evidence law in our country, this paper briefly introduces the basic concept of the burden of proof. The origin and early theory of the rules of burden of proof, and then the discussion of the new development trend of the theory of distribution of burden of proof. In short, based on the allocation of burden of proof, the basic purpose of this paper is to maintain the fairness and justice of the law, referring to various theories and theories, the distribution of the burden of proof in marine insurance is discussed comprehensively. The distribution rules system of the burden of proof of marine insurance in our country is constructed preliminarily.
