【摘要】：作者認(rèn)為現(xiàn)代市場(chǎng)經(jīng)濟(jì)需要兩種調(diào)節(jié)機(jī)制。民商法是市場(chǎng)調(diào)節(jié)的法律保障;經(jīng)濟(jì)法是國家調(diào)節(jié)的法律保障。現(xiàn)代市場(chǎng)經(jīng)濟(jì)法律體系是包括多個(gè)部門法規(guī)范的龐大系統(tǒng)工程。該法律體系的內(nèi)容構(gòu)成,包括經(jīng)濟(jì)主體和社會(huì)經(jīng)濟(jì)結(jié)構(gòu)、各經(jīng)濟(jì)主體的經(jīng)濟(jì)行為和整個(gè)社會(huì)經(jīng)濟(jì)運(yùn)行、市場(chǎng)及其他外部環(huán)境、經(jīng)濟(jì)糾紛與違法犯罪處理共四個(gè)方面的法律規(guī)范。為建立和完善我國市場(chǎng)經(jīng)濟(jì)法律體系,應(yīng)大力加強(qiáng)國家宏觀經(jīng)濟(jì)調(diào)控立法;改善和完善各種微觀經(jīng)濟(jì)立法;應(yīng)將立法區(qū)分具有穩(wěn)定性的基本性立法與過渡性立法,前者是直接構(gòu)造市場(chǎng)經(jīng)濟(jì)法律體系大廈的工程,后者是為最終建造大廈的材料加工制作。
[Abstract]:The author thinks the modern market economy needs two kinds of adjustment mechanism. Civil and commercial law is the legal guarantee of market regulation, and economic law is the legal guarantee of state regulation. The legal system of modern market economy is a huge system project which includes many laws and regulations. The content of the legal system consists of four aspects: the economic subject and the social economic structure, the economic behavior of the economic subjects and the whole social and economic operation, the market and other external environment, the economic disputes and the handling of illegal crimes. In order to establish and perfect the legal system of market economy in our country, we should strengthen the national macroeconomic regulation and control legislation, improve and perfect all kinds of microeconomic legislation, distinguish the legislation from the stable basic legislation and transitional legislation. The former is the project of building the legal system of market economy directly, and the latter is the material processing for the final building.
