【摘要】:現(xiàn)代海上保險(xiǎn)合同無(wú)不把共同海損、救助報(bào)酬和施救費(fèi)用列為承保范圍,人們往往誤認(rèn)為,保險(xiǎn)人對(duì)于在海上航程中發(fā)生的共同海損、救助報(bào)酬以及施救費(fèi)用都負(fù)責(zé)賠償。實(shí)際上,保險(xiǎn)人的賠償責(zé)任是以保險(xiǎn)合同為基礎(chǔ)的,保險(xiǎn)人為了自身利益,往往在保險(xiǎn)單中,對(duì)共同海損、救助報(bào)酬和施救費(fèi)用的認(rèn)定及計(jì)算作出特別規(guī)定。 另外,雖然共同海損、救助報(bào)酬和施救費(fèi)用都是被保險(xiǎn)人為拯救保險(xiǎn)標(biāo)的而產(chǎn)生的,具有相似性,但是這三者性質(zhì)不同,保險(xiǎn)賠償方式亦不相同,因此,在保險(xiǎn)實(shí)踐中準(zhǔn)確把握這三種損失的性質(zhì)并加以區(qū)分,有非常重要的意義。 我國(guó)《海商法》和有關(guān)保險(xiǎn)條款中,關(guān)于保險(xiǎn)人共同海損、救助報(bào)酬和施救費(fèi)用賠償責(zé)任的規(guī)定仍有許多不完善的地方。本文通過(guò)借鑒英國(guó)《1906年海上保險(xiǎn)法》、英國(guó)協(xié)會(huì)保險(xiǎn)條款和《2010年挪威海上保險(xiǎn)方案》,對(duì)我國(guó)《海商法》和相關(guān)保險(xiǎn)條款中有關(guān)保險(xiǎn)人共同海損、救助報(bào)酬和施救費(fèi)用賠償責(zé)任的規(guī)定提出了相應(yīng)的修改建議,包括但不限于如下內(nèi)容:(1)保險(xiǎn)條款中應(yīng)明確保險(xiǎn)人的共同海損、救助報(bào)酬賠償責(zé)任必須以承保風(fēng)險(xiǎn)為基礎(chǔ);(2)在船殼險(xiǎn)和貨運(yùn)險(xiǎn)的保險(xiǎn)條款中,應(yīng)明確將涉及環(huán)境因素的費(fèi)用和責(zé)任包括特別補(bǔ)償,作為除外責(zé)任加以規(guī)定;(3)擴(kuò)大船舶全損險(xiǎn)的承保范圍,將施救費(fèi)用也包括在全損險(xiǎn)中;(4)不足額保險(xiǎn)下保險(xiǎn)人的共同海損、救助報(bào)酬和施救費(fèi)用賠償責(zé)任的計(jì)算都應(yīng)以保險(xiǎn)價(jià)值為基礎(chǔ);(5)針對(duì)共同海損理算時(shí)間長(zhǎng)和費(fèi)用高的問(wèn)題,我國(guó)可以借鑒挪威船舶保險(xiǎn)條款中的共同海損吸收條款,簡(jiǎn)化對(duì)小額共同海損案件的處理。
[Abstract]:In modern marine insurance contracts, the general average, salvage reward and salvage expenses are all included in the scope of coverage. People often mistake the insurer for compensation for general average, salvage reward and rescue expenses incurred on voyages at sea. In fact, the insurer's liability is based on the insurance contract, the insurer, for its own benefit, often in the insurance policy, the general average, salvage compensation and rescue expenses for the determination and calculation of special provisions. In addition, although the general average, salvage reward and salvage expenses are all generated by the insured in order to save the subject matter of insurance, they are similar, but the three are different in nature and the way of insurance compensation is also different, so, It is of great significance to accurately grasp the nature of these three losses and distinguish them in the practice of insurance. There are still many imperfections in the maritime law of our country and the relevant insurance provisions concerning the liability of the insurer for general average, compensation for salvage and salvage expenses. By referring to the British Marine Insurance Act 1906, the British Association Insurance Clause and the Norwegian Marine Insurance Scheme 2010, this paper deals with the general average of insurers in the Maritime Code of China and the relevant insurance clauses. The provisions on compensation for compensation for salvage and rescue expenses have been proposed for amendment, including, but not limited to, the following contents: 1) the insurance clause shall specify the general average of the insurer, Compensation for compensation for salvage must be based on underwriting risks. In the insurance clauses for hull and freight insurance, the costs and liabilities relating to environmental factors should be explicitly included in special compensation, To extend the coverage of the ship's total loss insurance and to include the salvage expenses in the total loss insurance as well as to cover the general average of the insurer if the insurance is not fully insured, Compensation for salvage and salvage expenses should be calculated on the basis of insurance value. (5) in view of the problem of long adjustment time and high cost of general average adjustment, China can draw lessons from the general average absorption clause in the Norwegian marine insurance clause. To simplify the handling of small general average cases.
