【摘要】：本文通過對(duì)民國時(shí)期定貨契約習(xí)慣及違約糾紛裁處的考察,揭示商事習(xí)慣在維系交易秩序中的作用。認(rèn)為盡管其時(shí)國家制定了獨(dú)立的商法,商事習(xí)慣仍在維系交易秩序中發(fā)揮至關(guān)重要的作用。商事習(xí)慣通過不同形式的社會(huì)力量約束商行為,而不同的社會(huì)力量則構(gòu)成對(duì)交易行為的多層管理體系。這是保證民國時(shí)期商務(wù)正常開展,商業(yè)渠道暢通的重要因素之一。
[Abstract]:This paper reveals the role of commercial custom in maintaining trade order by investigating the custom of ordering contract and the tribunal of breach of contract during the period of the Republic of China. In spite of the independent commercial law, commercial custom still plays an important role in the maintenance of transaction order. Commercial habits restrict commercial firms through different forms of social forces, and different social forces constitute a multi-level management system for transaction behavior. This is to ensure the normal conduct of business during the Republic of China, commercial channels open one of the important factors.
