This paper highlights the relationship between maritime liens and the persons against whom the maritime claims secured by maritime liens are made. With reference to the law and practice of some other countries, such as UK, USA, Canada and France, as well as the relevant international conventions, further discussion is focused on the relevant provisions contained in the Maritime Code of the PRC. This paper highlights the relationship between maritime liens and the persons against whom the maritime claims secured by maritime liens are made. With reference to the law and practice of some other countries, such as UK, USA, Canada and France, as well as the relevant international conventions, further discussion is focused on the relevant provisions contained in the Maritime Code of the PRC. It is concluded that under the Maritime Code of the PRC, only those maritime claims against the owners, the demise charterers and the operators of the vessel in respect of which the maritime claims arise may be secured by the maritime liens attaching to the vessel.

本文重點(diǎn)討論船舶優(yōu)先權(quán)與其所擔(dān)保的海事請(qǐng)求的被請(qǐng)求人的關(guān)系。在闡述英國(guó)、美國(guó)、加拿大和法國(guó)的法律與實(shí)踐以及有關(guān)的國(guó)際公約的規(guī)定的基礎(chǔ)上 ,進(jìn)一步討論了中國(guó)《海商法》的有關(guān)規(guī)定。得出的結(jié)論是 :根據(jù)中國(guó)《海商法》的規(guī)定 ,只有那些針對(duì)當(dāng)事船的船舶所有人、光船承租人和船舶經(jīng)營(yíng)人的海事求才受以當(dāng)事船為客體的船舶優(yōu)先權(quán)的擔(dān)保。

Comparing the international conventions relating to Maritime Liens with the Maritime Code of the PRC,from legislative point of view,the paper studies the characters and developing trend of the items and procedure of Maritime liens.

通過(guò)對(duì)有關(guān)船舶優(yōu)先權(quán)國(guó)際立法及我國(guó)《海商法》中相關(guān)內(nèi)容的比較 ,從立法角度探究船舶優(yōu)先權(quán)項(xiàng)目及位序的特點(diǎn)及發(fā)展趨勢(shì)

Different jurisdictions have different attitudes towards the questions that which claims are secured by maritime liens and the order of being secured.The conflicts of law are obvious and serious.However,there is no generally accepted substantive convention.So the conflict of laws in different jurisdictions plays a very important role in governing the concerned cases.The trend of the conflict rules governing maritime lines is more complicated and precise to protect the vested rights.So the legislation...

Different jurisdictions have different attitudes towards the questions that which claims are secured by maritime liens and the order of being secured.The conflicts of law are obvious and serious.However,there is no generally accepted substantive convention.So the conflict of laws in different jurisdictions plays a very important role in governing the concerned cases.The trend of the conflict rules governing maritime lines is more complicated and precise to protect the vested rights.So the legislation of China adopting the principle of lex fori should be revised.

受英國(guó)海商制度的影響,我國(guó)《海商法》第272條規(guī)定:“船舶優(yōu)先權(quán)適用受理案件法院所在地的法律”,擬議中的《民法典》(草案)也承襲了這一規(guī)定。該項(xiàng)規(guī)定雖然簡(jiǎn)潔、明確,但卻過(guò)于強(qiáng)調(diào)本國(guó)法的適用,容易造成不公平的審判結(jié)果。實(shí)際上,盡管各國(guó)船舶優(yōu)先權(quán)制度的法律沖突嚴(yán)重,法律適用規(guī)則也相互歧異,但從總的發(fā)展趨勢(shì)來(lái)看,船舶優(yōu)先權(quán)的法律適用應(yīng)當(dāng)盡量擯棄本地法主義,用更為周密、完整的條文保護(hù)船舶優(yōu)先權(quán)人的既得權(quán)。
