【摘要】: 海事賠償責(zé)任限制制度,是指在發(fā)生重大海損事故造成財(cái)產(chǎn)損失或人身傷亡時(shí),作為責(zé)任人的船舶所有人、船舶承租人、船舶經(jīng)營(yíng)人和救助人等責(zé)任限制主體,可依法將其賠償責(zé)任限制在一定限度內(nèi)的賠償制度。它是海商法獨(dú)具特色的法律制度,是海商法賦予船舶所有人、經(jīng)營(yíng)人、承租人和救助人的一項(xiàng)特權(quán)。其根本目的在于保護(hù)和促進(jìn)航運(yùn)業(yè)的發(fā)展,從而使航運(yùn)業(yè)的相關(guān)主體能夠充分地利用這一法定的特權(quán)保護(hù)自身利益。法律通常規(guī)定海事責(zé)任人享受海事賠償責(zé)任限制的權(quán)利要經(jīng)過特定的程序,因此,完善的海事賠償責(zé)任限制程序是海事責(zé)任人實(shí)現(xiàn)其海事賠償責(zé)任限制權(quán)利的重要保障。 為此,國(guó)際海事委員會(huì)(CMI)制定了《關(guān)于統(tǒng)一海事賠償責(zé)任限制程序規(guī)則指南》,來統(tǒng)一各國(guó)有關(guān)責(zé)任限制程序性規(guī)則的立法,以便更好地實(shí)施和適用公約。本文從介紹CMI《責(zé)任限制程序規(guī)則指南》的制定背景和內(nèi)容入手,分析了我國(guó)現(xiàn)行海事賠償責(zé)任限制程序立法中存在的若干問題,以及對(duì)如何借鑒CMI《責(zé)任限制程序規(guī)則指南》來完善我國(guó)海事賠償責(zé)任限制程序制度提出建議。全文分為四個(gè)部分: 第一部分概述了CMI《責(zé)任限制程序規(guī)則指南》的制定背景和意義。本章從介紹CMI的基本情況入手,闡述了CMI對(duì)于責(zé)任限制程序問題的關(guān)注及其對(duì)此所作的努力,并對(duì)其成果《責(zé)任限制程序規(guī)則指南》的適用范圍及意義作了闡述。 第二部分詳細(xì)介紹了CMI《責(zé)任限制程序規(guī)則指南》的具體內(nèi)容,分四個(gè)方面對(duì)其條文的制定背景和具體內(nèi)容進(jìn)行闡述并加以評(píng)析。 第三部分首先介紹了我國(guó)海事賠償責(zé)任限制程序制度的立法現(xiàn)狀,接著分析了現(xiàn)行立法中存在的一些突出問題。 第四部分從完善我國(guó)海事賠償責(zé)任限制程序制度需要解決的理論困惑入手,分析了設(shè)立責(zé)任限制基金與責(zé)任限制程序的關(guān)系以及基金設(shè)立的目的,最后借鑒CMI《責(zé)任限制程序規(guī)則指南》對(duì)我國(guó)建立完整的海事賠償責(zé)任限制程序制度作出具體設(shè)計(jì)。
[Abstract]:The system of limitation of liability for maritime claims refers to the subject of limitation of liability, such as the owner, charterer, operator and salvor of the ship who is responsible for the loss of property or personal injury caused by a major average accident, The compensation system which can limit its liability to a certain limit according to law. It is a unique legal system of maritime law and a privilege granted by maritime law to ship owners, operators, charterers and rescuers. Its fundamental purpose is to protect and promote the development of shipping industry, so that the relevant subjects of shipping industry can make full use of this statutory privilege to protect their own interests. The law usually stipulates that the right of the maritime liability person to enjoy the limitation of maritime claim liability has to go through a special procedure. Therefore, the perfect limitation procedure of maritime claim liability is an important guarantee for the maritime responsibility person to realize the limitation right of maritime claim liability. For this reason, the International Maritime Committee (CMI) has formulated the Guide on uniform rules of procedure for limitation of liability for Maritime claims, in order to harmonize the legislation of various countries on the procedural rules of limitation of liability, so as to better implement and apply the Convention. Starting with the introduction of the background and content of CMI's Guide to liability limitation procedure, this paper analyzes some problems existing in the current legislation of liability limitation procedure for maritime claims in China. It also puts forward some suggestions on how to use CMI's Guide of liability limitation procedure for reference to perfect the limitation procedure system of maritime claims liability in China. The full text is divided into four parts: The first part summarizes the background and significance of CMI guidelines for liability limitation procedure. This chapter begins with the introduction of the basic situation of CMI, expounds the attention of CMI to the procedure of limitation of liability and its efforts, and expounds the application scope and significance of its achievement, "Guide to the rules of procedure for limitation of liability". The second part introduces the specific contents of CMI's "Guide to the rules of procedure for limitation of liability" in detail, and expounds and comments on the background and content of its provisions from four aspects. The third part firstly introduces the legislation status of the limitation procedure system of maritime claims liability in China, and then analyzes some outstanding problems in the current legislation. The fourth part analyzes the relationship between liability limitation fund and liability limitation procedure, as well as the purpose of fund establishment, starting with the theoretical confusion that needs to be solved to perfect the limitation procedure system of maritime claims liability in China. Finally, using CMI's Guide for liability limitation procedure as reference, the author makes a concrete design to establish a complete system of liability limitation procedure for maritime claims in China.
