【摘要】：自然資本投資是目前學界和政界高度重視的一個問題,國內(nèi)相關(guān)研究成果比較匱乏。本刊特意組織的五篇文章或慎重地對"以自然規(guī)律為遵循的人類生存發(fā)展之道究竟應(yīng)當包含哪些內(nèi)容,從法學的角度進行猜測";或力主"生態(tài)經(jīng)濟是自然資本經(jīng)濟,其內(nèi)容就是自然資本投資","自然資本的非資本化主要是因為法律與政策的不當安排造成的,中國現(xiàn)行法律安排已遠遠落后于自然資本投資的實際需要,法律必須建立自然資本市場制度";或探討了自然資本投資對可持續(xù)發(fā)展的環(huán)境資源法制建設(shè)的啟示;或質(zhì)疑自然資本投資的法律保護屬性,認為其制度設(shè)計屬于民商法和國際法范疇;或?qū)ψ匀毁Y本主義與可持續(xù)發(fā)展的契合性加以審視,認為將自然視為資本離真正的可持續(xù)發(fā)展理念差距尚遠。希望通過對這些文章的推介,將對自然資本投資問題的研究引向深入。
[Abstract]:Natural capital investment is a problem of current academic and political circles attach great importance to the domestic related research results are scarce. Five this magazine article specially organized or carefully in order to follow the laws of nature for human survival and development of the road should contain what content, guess "from the angle of law; or for" ecological the economy is the economy of natural capital, its content is the natural capital investment "," natural capital - capital is mainly because of the improper arrangement of legal and policy caused by the actual needs Chinese current legal arrangement has been far behind the natural capital investment, the law must establish natural capital market system "; or of the natural capital investment environment the legal construction of resources for sustainable development of the enlightenment; or questioned the legal attribute of natural capital investment protection, the design of the system of civil law and international law belongs to the category of; or The coincidence between natural capitalism and sustainable development is reviewed. It is considered that capital is far from the real concept of sustainable development. I hope that through the introduction of these articles, we will further study the issue of natural capital investment.
