船舶優(yōu)先權若干問題研究

【摘要】: 船舶優(yōu)先權是海商法園林中的一朵奇葩,作為海商法船舶物權中一項特有的法律制度,雖然其在船舶物權中并非居于核心地位,但卻是爭議最多的領域。就我國而言,系統(tǒng)研究船舶優(yōu)先權的著作并不多見,筆者選取這一題目,希望通過對國際立法和各類理論學說的考察,進一步深化對這一領域的研究,為船舶優(yōu)先權的理論和實踐方面貢獻綿薄之力。 本文共分四章。第一章是關于船舶優(yōu)先權的理論脈絡的研究,從船舶優(yōu)先權的起源入手,對創(chuàng)建船舶優(yōu)先權制度的初衷進行了考察。接下來,從理論和立法的角度,對船舶優(yōu)先權的演進進行了梳理,系統(tǒng)的列舉出了船舶優(yōu)先權演進過程中出現(xiàn)的比較有影響的理論和立法模式。 第二章是關于船舶優(yōu)先權概念和法律性質的研究。在學理研究和學說比較的基礎上,提出了自己關于優(yōu)先權概念和法律性質的認識。首先,筆者指出了分析研究船舶優(yōu)先權性質的意義,即在管轄權方面和適用法律上的意義;其次作者列舉了對于船舶優(yōu)先權性質的種種爭議,并對物權說、債權說、債權物權化等學說一一進行分析。最后,筆者得出自己的結論,認為船舶優(yōu)先權應屬于物權中的擔保物權,并從7個方面對此進行了論證。 第三章是關于破產對于船舶優(yōu)先權的影響。主要分三個部分,即破產清算、重整、和解對于船舶優(yōu)先權行使的影響。另外,本文還分析了域外破產對于船舶優(yōu)先權人的影響。最后,對于破產中對船舶優(yōu)先權人的保護,提出了自己的立法建議。 第四章是關于定期租船、航次租船下承租人支付工資后能否取得船舶優(yōu)先權的問題。筆者認為,承租人支付工資能否取得船舶優(yōu)先權不可一概而論。在三種不同的情形下存在著不同的法律關系和法律后果,并從理論依據、立法目的、可操作性等方面入手,對定期租船、航次租船下承租人支付工資能否取得船舶優(yōu)先權進行了全面的分析,分別得出了三種情形下的不同結論。
[Abstract]:Maritime lien is a wonderful flower in maritime law garden. As a special legal system in maritime law, maritime lien is not the core of ship real right, but it is the most controversial field.As far as our country is concerned, there are few works on the systematic study of maritime liens. The author chooses this topic and hopes to further deepen the research in this field through the investigation of international legislation and various theories.To contribute to the theoretical and practical aspects of maritime liens.This paper is divided into four chapters.The first chapter is the research on the theoretical context of maritime lien, starting with the origin of maritime lien, the original intention of establishing maritime lien system is investigated.Then, from the perspective of theory and legislation, the evolution of maritime liens is combed, and the more influential theories and legislative models in the evolution of maritime liens are listed systematically.The second chapter is about the concept and legal nature of maritime lien.On the basis of theoretical research and theoretical comparison, the author puts forward his own understanding of the concept and legal nature of priority.First of all, the author points out the significance of analyzing and studying the nature of maritime lien, that is, the meaning of jurisdiction and applicable law; secondly, the author enumerates all kinds of disputes about the nature of maritime lien, and the theory of real right and creditor's rights.The theory of property right of creditor's rights is analyzed one by one.Finally, the author draws his own conclusion that maritime liens should belong to the real right of security, and demonstrates this from seven aspects.The third chapter deals with the impact of bankruptcy on maritime liens.It is mainly divided into three parts: bankruptcy liquidation, reorganization and settlement of the impact on the exercise of maritime liens.In addition, this paper also analyzes the impact of bankruptcy on maritime liens.Finally, the author puts forward his own legislative suggestions for the protection of maritime liens in bankruptcy.The fourth chapter deals with the issue of whether the charterer can obtain the maritime lien after paying wages.In my opinion, whether the charterer can obtain the maritime lien can not be generalized.There are different legal relations and legal consequences in three different situations, and from the theoretical basis, legislative purpose, maneuverability and other aspects, charter ship on time,This paper makes a comprehensive analysis on whether the charterer can obtain the maritime lien by paying wages under voyage charterers, and draws different conclusions under three circumstances.
