論海運(yùn)貨物控制權(quán)

【摘要】:有關(guān)貨物運(yùn)輸?shù)默F(xiàn)行公約中,涉及航空、鐵路和公路運(yùn)輸?shù)墓s均對貨物控制權(quán)作了相應(yīng)地規(guī)定。在海運(yùn)領(lǐng)域中,雖然1990年《CMI海運(yùn)單統(tǒng)一規(guī)則》和《CMI電子提單規(guī)則》均規(guī)定了貨物控制權(quán),但這兩個(gè)規(guī)則的適用范圍過窄,不能適應(yīng)現(xiàn)代海運(yùn)實(shí)踐的需要。作為現(xiàn)存三大國際公約的替代品,,《UNCITRAL運(yùn)輸法草案》(以下簡稱《運(yùn)輸法草案》)規(guī)定了“貨物控制權(quán)”的概念及其相關(guān)規(guī)則。本文試圖通過研究“海運(yùn)貨物控制權(quán)”的相關(guān)內(nèi)容,探討中國引入這一制度的必要性和可能性。本文主要運(yùn)用法的價(jià)值研究方法,從理論和實(shí)踐兩個(gè)方面,研究了貨物控制權(quán)制度。 本文主要分為五個(gè)部分。第一章論述了我國引入貨物控制權(quán)的必要性,并從法的價(jià)值的角度對貨物控制權(quán)的價(jià)值進(jìn)行分析。第二章是本文的主體,主要參照《運(yùn)輸法草案》,同時(shí)聯(lián)系其他運(yùn)輸公約中關(guān)于控制權(quán)的規(guī)定,研究海運(yùn)貨物控制權(quán)的概念、主體、性質(zhì)、行使條件等相關(guān)內(nèi)容。第三章通過對中途停運(yùn)權(quán)的簡要研究,比較海運(yùn)貨物控制權(quán)與中途停運(yùn)權(quán)之間的異同。雖然兩者有形似之處,但它們在理論淵源、主體、內(nèi)容、行使條件等方面存在的差異很明顯。第四章總結(jié)《運(yùn)輸法草案》的規(guī)定可能存在的問題,雖然《運(yùn)輸法草案》的規(guī)定有助于解決貨物運(yùn)輸發(fā)與貨物買賣法之間的矛盾,但這些規(guī)定也并非嚴(yán)密和周全,這也是一直對《運(yùn)輸法草案》進(jìn)行修改的原因。第五章主要探討我國法律有關(guān)貨物控制權(quán)的規(guī)定與完善建議。在我國的法律體系中,《海商法》未規(guī)定控制權(quán)制度,《合同法》第308條也只是關(guān)于控制權(quán)的一般規(guī)定,不能適應(yīng)海運(yùn)的特殊要求。 根據(jù)以上分析,筆者認(rèn)為我們應(yīng)借鑒《運(yùn)輸法草案》的成功之處,與時(shí)俱進(jìn),在我國的《海商法》中引入貨物控制權(quán),并且提出相關(guān)的立法建議。
[Abstract]:In existing conventions relating to the carriage of goods, conventions dealing with the carriage of goods by air, rail and road provide accordingly for the right of control of goods... in the field of maritime transport, Although the 1990 CMI uniform rules for Maritime bills and the CMI rules on Electronic Bills of Lading provide for the right of control of the goods, the scope of their application is too narrow. The draft UNCITRAL Transport Law (hereinafter referred to as "draft Transport Law") stipulates the concept of "right of control of goods" and its relevant rules. By studying the relevant contents of "right of Control over Maritime cargo", This paper discusses the necessity and possibility of introducing this system in China. This paper mainly uses the value research method of law to study the system of control right of goods from two aspects: theory and practice. This paper is divided into five parts. The first chapter discusses the necessity of introducing the right of control of goods in China, and analyzes the value of the right of control of goods from the point of view of the value of law. Referring mainly to the draft Transport Law, and in connection with the provisions of other transport conventions on the right of control, the paper studies the concept, subject, nature, and conditions of exercise of the right of control of maritime cargo. Chapter III, through a brief study of the right of stoppage in midway, This paper compares the similarities and differences between the control right of sea freight and the right of stoppage. Although they are similar in form, they are in the theoretical origin, subject and content. The differences in exercise conditions are obvious. Chapter IV summarizes the possible problems with the provisions of the draft Transport Law, although the provisions of the draft Transport Law help to resolve the conflict between the transport of goods and the law on the sale of goods. But these rules are not strict or thorough, This is also the reason why the draft Transport Law has been amended. Chapter five mainly discusses the regulations and suggestions on the right of control of goods in Chinese law. In the legal system of our country, the Maritime Law does not provide for the system of control rights. Article 308 of the contract law is also a general provision on control, Unable to meet the special requirements of sea transportation. Based on the above analysis, the author thinks that we should draw lessons from the success of the draft of Transport Law, keep pace with the times, introduce the right of control of goods in the Maritime Law of our country, and put forward relevant legislative suggestions.
