中韓住房租賃制度比較研究

【摘要】: 房屋租賃法律制度作為我國民商法中的一個重要制度,其設(shè)計合理與否直接關(guān)系到租賃雙方當(dāng)事人的權(quán)益。目前,在我國低收入家庭在社會中所占比例仍然很大,他們無力購買房屋只能采取租賃形式來解決住房需要。由于房屋承租人往往處于經(jīng)濟(jì)上的弱勢地位,其在房屋租賃中的權(quán)益更易受到侵害,具體表現(xiàn)為:承租人容易受到出租人的非法驅(qū)逐,導(dǎo)致其生活不穩(wěn)定,同時也將影響社會安定。而目前我國在房屋租賃方面的法律規(guī)定還比較粗糙,仍然存在許多與實(shí)踐脫節(jié)的地方,而且對承租人權(quán)益保護(hù)的關(guān)注仍顯不夠。本文將采用比較研究的方法,對中韓兩國的住房租賃制度進(jìn)行比較,并找出其異同點(diǎn);同時借鑒韓國對承租人權(quán)益保護(hù)的先進(jìn)經(jīng)驗對我國房屋租賃方面的法律制度進(jìn)行分析,并指出目前我國法律對承租人權(quán)益保護(hù)的不足,進(jìn)而提出立法上的建議。 本文分為六個部分。 第一章是緒論。本章中主要對本文的研究目的、研究范圍、及研究方法作了簡單的概括,并對文章的寫作初衷進(jìn)行了介紹。 第二章對房屋租賃制度進(jìn)行了介紹。這一章主要從房屋租賃的概念、特征、類型及國外立法例等方面入手,從而對房屋租賃制度有了一個較客觀的認(rèn)識。 第三章與第四章分別對中韓租賃制度的內(nèi)容、性質(zhì)、適用范圍、發(fā)展過程及發(fā)展趨勢進(jìn)行了論述;從而對中韓住房租賃保護(hù)法有了一個總體上的認(rèn)識。從而為第五章中韓租賃制度比較分析,進(jìn)行了理論鋪墊。 第五章作為本章的重點(diǎn),結(jié)合第三章、第四章中關(guān)于租賃制度的論述對中韓兩國的住房租賃制度進(jìn)行了比較分析,從而找出了兩國住房租賃制度方面的的共同點(diǎn)與區(qū)別點(diǎn),并在借鑒韓國《住房租賃保護(hù)法》的基礎(chǔ)上,在一定程度上提出了解決問題的方法,,提出了幾點(diǎn)淺顯的建議。 第六章作為本文的結(jié)語部分指出了目前我國住房租賃制度的不足,并建議合理利用韓國對住房租賃制度的先進(jìn)經(jīng)驗,用以專門保護(hù)住房租賃關(guān)系中雙方當(dāng)事人的權(quán)益,最后對我國房屋租賃方面提出立法上的建議,并對全文在理論上進(jìn)行了總結(jié)論述。
[Abstract]:As an important system in the civil and commercial law of our country, the legal system of house lease is directly related to the rights and interests of both parties. At present, the proportion of low-income families in the society is still very large. They cannot afford to buy a house but rent it to meet their housing needs. Because the tenants are often economically disadvantaged, their rights and interests in the lease are more vulnerable. The concrete manifestation is that the lessee is liable to be illegally evicted by the lessor, which leads to the instability of his life and will also affect the social stability. There are still many places which are out of touch with practice, and the protection of lessee's rights and interests is still not enough. This paper will use the method of comparative study to compare the housing leasing system between China and Korea, and find out the similarities and differences between the two countries. At the same time, drawing lessons from Korea's advanced experience on the protection of lessee's rights and interests, this paper analyzes the legal system of housing lease in China, and points out the deficiency of the protection of lessee's rights and interests in our country's laws at present, and then puts forward some suggestions on legislation. This paper is divided into six parts. The first chapter is the introduction. This chapter mainly summarizes the purpose, scope and research method of this paper, and introduces the original intention of the article. The second chapter introduces the housing lease system. This chapter mainly starts with the concept, characteristics, types and foreign legislation of the housing lease system, thus has a more objective understanding of the housing lease system. Chapter three and Chapter 4th respectively discuss the content, nature, scope of application, development process and development trend of the leasing system between China and Korea. Therefore, the author has a general understanding of China and South Korea Housing Lease Protection Law, which lays a theoretical foundation for the comparative analysis of Chinese and Korean rental systems in Chapter 5th. Chapter 5th as the focus of this chapter, combined with the third chapter, 4th chapter on the rental system of China and South Korea on the housing rental system comparative analysis, and thus found out the two countries housing rental system common points and differences. On the basis of drawing lessons from Korea's Housing Lease Protection Law, this paper puts forward some methods to solve the problem to a certain extent, and puts forward some simple suggestions. Chapter 6th, as the conclusion of this paper, points out the deficiency of the current housing lease system in our country, and suggests that Korea should make use of the advanced experience of housing lease system in order to protect the rights and interests of both parties in the housing lease relationship. In the end, the author puts forward some suggestions on the legislation of housing lease in our country, and summarizes the whole paper in theory.
