論國際海上貨物運輸中的留置權(quán)問題

【摘要】:本文主要以海運中的貨物留置權(quán)作為研究對象。 在我國,對于貨物留置權(quán)的規(guī)定散見于《民法通則》、《合同法》以及《擔保法》及其司法解釋,作者通過對貨物留置權(quán)的民法理論研究,討論海運中貨物留置權(quán)的特點。其中結(jié)合航運實務(wù)中存在的國內(nèi)沿海運輸和國際海上運輸兩種不同的運輸方式,闡述貨物留置權(quán)中一般貨物留置權(quán)和商事貨物留置權(quán)的異同,以及此種區(qū)分在航運實務(wù)中的意義。作者認為《海商法》中的貨物留置權(quán)屬于商事留置權(quán),其性質(zhì)、成立條件、行使方式等都與民法中的一般留置權(quán)存在較大差別。在論文中作者還對租約中留置權(quán)的一些問題進行研究,如航次租船中的責(zé)任終止條款、留置權(quán)條款,定期租船中的轉(zhuǎn)租收入等。尤其是對于“貨物所有權(quán)和留置權(quán)行使之間的關(guān)系”進行了較為深入的探討,并提出自己的拙見。 除了引言之外,本文共分為四章。 引言主要說明理論界對于貨物留置權(quán)的爭論和我國對于該問題的立法體例,闡述了作者研究的方向和寫作目的。 第一章簡單闡述了民法上留置權(quán)概念,留置權(quán)的歷史淵源以及特征,留置權(quán)與同時履行抗辯權(quán)、抵押權(quán)、質(zhì)權(quán)的區(qū)別。從留置權(quán)的性質(zhì)出發(fā),將其中的物權(quán)性留置權(quán)和債權(quán)性留置權(quán)進行比較,并且參照目前各國關(guān)于留置權(quán)的不同立法規(guī)定,尤其是對于英美法中的留置權(quán)制度進行了較為深入的討論。 第二章結(jié)合國際海上貨物運輸?shù)膶崉?wù),從各國對于海上貨物運輸留置權(quán)的不同規(guī)定出發(fā),尋找其中的異同,,對我國的貨物留置權(quán)問題進行仔細剖析。此外,還從海上貨物運輸留置權(quán)的成立要件、行使條件限制、效力范圍、留置權(quán)人的權(quán)利義務(wù)、留置物所有人的權(quán)利義務(wù)、貨物留置權(quán)的實行、消滅以及留置方式等方面進行闡述。 第三章重點從我國《海商法》中規(guī)定的貨物留置權(quán)的定義、性質(zhì)、所擔保的項目出發(fā),進行了全面論述。 第四章主要就租約中留置權(quán)的概念、特征進行簡單討論,對于程租中的責(zé)任終止條款和留置權(quán)條款、期租中的轉(zhuǎn)租收入、不同租約范本對留置權(quán)的規(guī)定等問題,進行了較為認真的研究。
[Abstract]:This article mainly takes the goods lien in the sea as the research object. In our country, the provisions of lien on goods are scattered in the General principles of Civil Law, contract Law, Guaranty Law and its judicial interpretation. This paper discusses the characteristics of the lien of goods in maritime transportation, and expounds the similarities and differences between the common lien of goods and the lien of commercial goods in combination with the two different modes of transport in domestic coastal transport and international maritime transport, which exist in shipping practice. The author thinks that the goods lien in Maritime Law belongs to the commercial lien, its nature and the conditions for its establishment. In this paper, the author also studies some problems of the lien in the lease, such as the clause of termination of responsibility in voyage charter, the clause of lien. Especially the relationship between the ownership of goods and the exercise of lien is discussed deeply, and their own views are put forward. In addition to the introduction, this paper is divided into four chapters. The preface mainly explains the debate on the lien of goods in the theoretical circle and the legislative style of this issue in our country, and expounds the research direction and writing purpose of the author. The first chapter briefly expounds the concept of lien in civil law, the historical origin and characteristics of lien, the difference between lien and concurrent performance of defense, mortgage and pledge. This paper compares the lien of real right with the lien of creditor's rights, and discusses the system of lien in Anglo-American law in depth, referring to the different legislative provisions about lien in various countries at present. The second chapter combines with the practice of international carriage of goods by sea, starting from the different provisions of the lien rights in the carriage of goods by sea, looking for the similarities and differences among them, and making a careful analysis of the issue of the lien of goods in our country. It also expounds the requirements of the establishment of the lien for the carriage of goods by sea, the restrictions on the exercise of conditions, the scope of validity, the rights and obligations of the lien holder, the rights and obligations of the owner of the lien, the implementation and elimination of the lien of goods, and the way of lien. The third chapter focuses on the definition, nature and guarantee of the lien of goods stipulated in the Maritime Law of China. Chapter 4th mainly discusses the concept and characteristics of the lien in the lease, discusses the termination clause and lien clause in the interim lease, the sublease income in the term lease, and the provisions on the lien of different lease models, etc. A more serious study was carried out.
