【摘要】： 提單，被公認為是國際貨物運輸中最為重要的單證，而研習提單權(quán)利屬性以及提 單法律制度亦成為攻讀、研究海商法者的第一要義。本文通過對提單所體現(xiàn)的財產(chǎn)權(quán) 利內(nèi)涵及提單和權(quán)利之間的關(guān)系進行研究，，并以民法中物權(quán)和債權(quán)概念作闡述，指出 提單作為權(quán)利憑證體現(xiàn)為其占有權(quán)憑證的功能，認為提單是一種廣義上的有價證券。 此外，本文確認信用證下銀行對提單擔保享有質(zhì)權(quán)。
[Abstract]:Bill of lading is recognized as the most important document in the international carriage of goods. The single legal system has also become the first important point of the study of maritime law. This paper deals with the property rights embodied in bills of lading. The connotation of interest and the relationship between bill of lading and rights are studied, and the concepts of real right and creditor's right in civil law are expounded. Bill of lading, as a document of rights, is regarded as a kind of securities in a broad sense. In addition, this paper confirms that the bank has the right to pledge the bill of lading guarantee under the letter of credit.
