【摘要】:船舶優(yōu)先權(quán)作為海商法一項(xiàng)古老的制度在促進(jìn)航運(yùn)業(yè)發(fā)展過程中發(fā)揮了重要 作用。世界各航運(yùn)國家關(guān)于船舶優(yōu)先權(quán)的法律規(guī)定日益完善,理論研究也十分豐 富,但是實(shí)踐中在具體行使船舶優(yōu)先權(quán)時(shí)卻存在很多問題,因此本文側(cè)重于從實(shí) 體和程序兩個(gè)角度對(duì)船舶優(yōu)先權(quán)行使的若干問題進(jìn)行研究,希望能對(duì)船舶優(yōu)先權(quán) 更好地發(fā)揮作用做出一點(diǎn)貢獻(xiàn)。本文首先分析了船舶優(yōu)先權(quán)行使的概念、特征、 條件及模式等問題,從而在理論上明確了船舶優(yōu)先權(quán)行使的基本內(nèi)容,為后文的 進(jìn)一步研究奠定基礎(chǔ)。世界兩大主要法系——英美法系和大陸法系國家都有關(guān)于 船舶優(yōu)先權(quán)的規(guī)定,但船舶優(yōu)先權(quán)行使的訴訟程序有很大不同,本文對(duì)兩者進(jìn)行 了研究。船舶優(yōu)先權(quán)的行使具有實(shí)體性,各國立法對(duì)船舶優(yōu)先權(quán)行使的權(quán)利主體、 義務(wù)主體及客體都有規(guī)定,但這些規(guī)定并不能解決實(shí)踐中復(fù)雜的問題。本文結(jié)合 實(shí)踐中常見的問題對(duì)權(quán)利主體、義務(wù)主體及客體進(jìn)行了分析研究,希望能有利于 實(shí)踐中問題的解決?鄞c船舶優(yōu)先權(quán)的行使具有十分密切的聯(lián)系,本文比較分 析了扣船與船舶優(yōu)先權(quán)行使的關(guān)系,并研究了多次扣船、“活扣”等情況下優(yōu)先權(quán) 的行使。在研究過程中,本文參照國外立法及有關(guān)國際公約,對(duì)我國船舶優(yōu)先權(quán) 行使立法規(guī)定存在的某些問題提出了完善建議。 實(shí)踐是復(fù)雜的,問題是多樣的,本文主要從以上四個(gè)方面對(duì)船舶優(yōu)先權(quán)的行 使進(jìn)行了研究,希望能對(duì)實(shí)踐中船舶優(yōu)先權(quán)行使過程中問題的解決有所益處。
[Abstract]:Maritime lien, as an ancient system of maritime law, plays an important role in promoting the development of shipping industry. The legal provisions on maritime liens of the world shipping countries are becoming more and more perfect, and the theoretical research is also very abundant. Rich, but in practice there are many problems in the specific exercise of maritime liens, so this paper focuses on the implementation of the. This paper studies several problems in the exercise of maritime liens from the aspects of body and procedure, and hopes to be able to make use of maritime liens. Some problems existing in the exercise of legislative provisions are put forward. It is hoped that it will be helpful to solve the problems in the process of maritime lien in practice.
