【摘要】： 保險代位求償制度是保險法中的一個重要制度,同時也是一個比較復(fù)雜的制度,涉及到多方權(quán)利。目前在立法上,我國已形成了相對比較完善的海上保險代位求償權(quán)法律體系,這些法律的規(guī)定對維護海上保險人代位求償?shù)暮戏?quán)利,保證海上保險代位求償訴訟的順利進行起到了十分重要的作用。但是這些規(guī)定存在漏洞甚至某些相互沖突之處。本文試以大陸法系民法理論為基礎(chǔ),重點針對我國海上保險代位求償法律體系中幾個不完善之處進行了深入探討。 本文第一部分首先從保險代位求償權(quán)的概念出發(fā),對其立法淵源以及立法例作一個初步檢視,然后探討了保險代位求償制度的立法目的,重點探討了保險代位求償權(quán)的性質(zhì)。本文的第二部分以及第三部分主要探討了保險代位求償權(quán)的行使及其限制。涉及到海上保險代位求償權(quán)的行使主體、前提條件、行使途徑、名義等具體問題。在行使限制方面,主要從對象、金額、時效等方面分別探討。本文的第四部分涉及了兩個保險代位訴訟當(dāng)中有爭議的問題,即“權(quán)利轉(zhuǎn)讓書”性質(zhì)的問題以及是否需要審查保險合同的問題。
[Abstract]:The subrogation system of insurance is an important system in the insurance law, and it is also a complicated system, which involves many rights. At present, our country has formed a relatively perfect legal system of subrogation right of marine insurance. The provisions of these laws protect the legitimate right of maritime insurers to subrogation, It has played an important role in ensuring the smooth progress of subrogation litigation of marine insurance. However, there are some loopholes and even some conflicts in these provisions. This paper tries to base on the civil law theory of the civil law system. This paper focuses on several imperfections in the legal system of subrogation of marine insurance in China. The first part of this paper starts from the concept of insurance subrogation right, makes a preliminary examination of its legislative origin and legislative example, and then probes into the legislative purpose of insurance subrogation system. The second part and the third part of this paper mainly discuss the exercise and limitation of insurance subrogation, which involve the subject, precondition and way of subrogation in marine insurance. In the aspect of exercise restriction, it is mainly discussed from the aspects of object, amount of money, limitation and so on. The 4th part of this paper deals with the controversial issues in the two insurance subrogation proceedings. The issue of the nature of the instrument of assignment and the need to review insurance contracts.
