《鹿特丹規(guī)則》下海運(yùn)履約方制度探析

【摘要】:《聯(lián)合國(guó)全程或者部分國(guó)際海上貨物運(yùn)輸合同公約》(即《鹿特丹規(guī)則》)于2008年12月11日經(jīng)聯(lián)合國(guó)大會(huì)第六十三屆會(huì)議第六十七次全體會(huì)議審議通過,并于2009年9月23日在鹿特丹成功舉行簽字儀式!堵固氐ひ(guī)則》引入了“海運(yùn)履約方”這一全新的海運(yùn)主體概念,這不但充分適應(yīng)了規(guī)則確立的“門到門”的調(diào)整范圍,也使此概念與“履約方”和“承運(yùn)人”概念一道構(gòu)建并開創(chuàng)了海上運(yùn)輸主體分類的新格局和責(zé)任制度的新紀(jì)元。 本文大致分為四部分: 第一部分將概括介紹海運(yùn)履約方概念的發(fā)展沿革,這是正確理解公約最終形成的觀點(diǎn)的基礎(chǔ),同時(shí)也明確了本文的研究對(duì)象。 第二部分將分析履約方和海運(yùn)履約方的定義和范圍,并對(duì)海運(yùn)履約方作類型化分析。同時(shí)運(yùn)用比較研究的方法,進(jìn)一步闡述履約方和海運(yùn)履約方的區(qū)分實(shí)意。 第三部分將對(duì)海運(yùn)履約方在公約下的義務(wù)和核心責(zé)任制度,包括責(zé)任期間、歸責(zé)原則、賠償責(zé)任限制及其喪失以及賠償責(zé)任范圍等進(jìn)行分析,以期更加明確海上貨物運(yùn)輸過程中各方的權(quán)利義務(wù)關(guān)系。 第四部分將結(jié)合我國(guó)目前《海商法》實(shí)際承運(yùn)人制度在理論和司法實(shí)踐中存在的問題以及港站經(jīng)營(yíng)人的法律地位和責(zé)任制度不明確的現(xiàn)狀,提出若干立法建議,建議我國(guó)《海商法》借鑒海運(yùn)履約方制度,完善相關(guān)履約輔助人制度。
[Abstract]:The United Nations Convention on contracts for the International Carriage of goods wholly or partly by Sea (the Rotterdam rules) was considered and adopted on 11 December 2008 at the 67th plenary meeting of the 63th session of the General Assembly of the United Nations, In September 23rd 2009, the signing ceremony was successfully held in Rotterdam. The Rotterdam rules introduced the new maritime subject concept of "maritime performing party", which not only fully adapted to the "door-to-door" adjustment scope established by the rules, This concept, together with the concepts of "performing party" and "carrier", has also created a new pattern of classification of maritime transport subjects and a new era of liability system. This paper is divided into four parts:. The first part will introduce the development and evolution of maritime performing party concept, which is the basis of correct understanding of the final formation of the Convention, and at the same time, it also defines the research object of this paper. In the second part, the definition and scope of the performing party and the maritime performing party are analyzed, and the classification of the maritime performing party is analyzed. At the same time, by using the method of comparative study, the actual meaning of the distinction between the performing party and the maritime performing party is further expounded. The third part will provide an analysis of the obligations and core liability regimes of maritime performing parties under the Convention, including the period of responsibility, the principle of imputation, limitation and loss of liability and the scope of liability, In order to clarify the rights and obligations of the parties in the process of carriage of goods by sea. The 4th part will put forward some legislative suggestions according to the problems existing in the theory and judicial practice of the actual carrier system in China's Maritime Law and the unclear legal status and liability system of the operators of port stations. It is suggested that China's Maritime Law should draw lessons from the maritime performing party system and perfect the relevant performance assistant system.
