隱私法:對中國和歐盟最新法律發(fā)展的比較

近年來,隱私法的發(fā)展在中國和歐盟都邁出了重要的一步。歐盟發(fā)布了于2018年5月25日生效的GDPR.(Reg(EU)2016/679),而《網(wǎng)絡(luò)安全法》在中國得到了重大更新和升級,其中,2017年12月29日,中國發(fā)布了最新修訂的國標(biāo)GB/t 35273-2017,稱為“個人信息安全規(guī)范”,該規(guī)范于2018年5月1日生效。除了適用日期相似之外,這兩套規(guī)則還有許多重疊的方面,這表明歐盟和中國在這方面越來越關(guān)注的份額。盡管形式相似,但這些規(guī)則的實質(zhì)不同。因此,比較這些法律(在各自的背景下),對于確定這兩個法律體系中隱私權(quán)的理念以及為什么在中國更寬松地采用某些歐洲規(guī)則可能很有用。
