【摘要】：作為新型的交易制度,融資租賃交易在開展的過程中普遍存在買賣、租賃、貸款、擔(dān)保制度的交叉狀況,故而導(dǎo)致融資租賃交易的性質(zhì)界定存在多種學(xué)說。這種狀況的出現(xiàn)往往導(dǎo)致學(xué)術(shù)界就融資租賃中租賃物的所有權(quán)歸屬存在差異性的理解。本文認為,盡管融資租賃交易體現(xiàn)出多種交易形式的特征,但是其本質(zhì)上仍舊是以租金換取租賃物使用權(quán),實現(xiàn)融資目的。目前,學(xué)術(shù)界立足實際狀況,進一步強化對于租賃物所有權(quán)關(guān)系的研究,從而確保融資租賃工作在開展時能夠明確各物品的所有權(quán),確保權(quán)利義務(wù)關(guān)系界定,促進融資租賃事業(yè)的發(fā)展強盛,確保各項經(jīng)濟效益的取得。
[Abstract]:As a new type of transaction system, there are many theories in the process of financial lease transaction, such as buying and selling, leasing, loan and guarantee system, so there are many theories to define the nature of financial lease transaction. The emergence of this situation often leads to a different understanding of the ownership of leased items in financial leasing. This paper holds that although the financial lease transaction embodies the characteristics of many forms of transaction, it is still in essence to exchange rent for the right to use the lease item to achieve the purpose of financing. At present, based on the actual situation, the academic circles further strengthen the research on the ownership relationship of leasing items, so as to ensure that the financial leasing work can clarify the ownership of each item, ensure the definition of the relationship between rights and obligations, promote the development of financial leasing, and ensure the acquisition of various economic benefits.
