【摘要】：文章以"�；丶铱纯�"入法為例,考察城市老年人對(duì)于精神贍養(yǎng)入法合理性的認(rèn)識(shí)及其影響因素,進(jìn)而上升到理論層面,探究個(gè)體權(quán)利意識(shí)的決定因素。研究結(jié)果表明:第一,孤獨(dú)感不影響城市老年人對(duì)于精神贍養(yǎng)入法合理性的認(rèn)識(shí);第二,老年人的主觀需求與子女精神贍養(yǎng)水平(除與子女聊天的頻率之外)影響城市老年人對(duì)于精神贍養(yǎng)入法合理性的認(rèn)識(shí);第三,老年人的身體健康狀況與月均收入影響城市老年人對(duì)于精神贍養(yǎng)入法合理性的認(rèn)識(shí)�？梢�,在城市老年人現(xiàn)代性普遍提高的背景下,他們主要是因?yàn)闄?quán)益受損而主張維護(hù)自己的權(quán)利。因此,相關(guān)法律政策的完善應(yīng)考慮給予弱勢(shì)老年人以更多的保護(hù)。
[Abstract]:Taking the entry method of "often go home to see" as an example, this paper examines the understanding and influencing factors of the rationality of spiritual support law for the elderly in cities, and then rises to the theoretical level to explore the decisive factors of individual right consciousness. The results show that: first, loneliness does not affect the understanding of the rationality of spiritual support into the law of the urban elderly; second, the subjective needs of the elderly and the level of spiritual support of their children (except the frequency of chatting with their children) affect the understanding of the rationality of the spiritual support into the law of the urban elderly; third, the physical health status and monthly average income of the elderly affect the understanding of the rationality of the spiritual support into the law of the urban elderly. It can be seen that under the background of the general improvement of the modernization of the urban elderly, they mainly advocate to safeguard their rights because of the damage of their rights and interests. Therefore, the improvement of relevant legal policies should consider giving more protection to the vulnerable elderly.
