【摘要】：公序良俗在裁判中的運用自2013年起增加迅速,涉及法律行為、侵權(quán)行為和不當(dāng)?shù)美雀黝I(lǐng)域。司法適用中存在以一般道德標(biāo)準(zhǔn)替代公序良俗、概念混用和割裂公共秩序與善良風(fēng)俗等公序良俗界定問題,也包括判斷對象錯誤、向一般條款逃逸等適用不規(guī)范問題。公序良俗司法適用問題之應(yīng)對策略包括兩大方面:一是要實現(xiàn)民法外部與內(nèi)部價值有效溝通,具體包括界定公序良俗原則以增加確定性、充分發(fā)揮其引致作用、加強原則在民法內(nèi)部區(qū)分控制。二是保障公序良俗原則之科學(xué)適用,具體包括明確適用條件、采取類型化適用方法、總結(jié)裁判中成熟類型和關(guān)注債務(wù)人超出自己預(yù)計給付能力、基本權(quán)利維護(hù)等我國裁判中尚未涉及之類型。
[Abstract]:The use of public order and good customs in adjudication has increased rapidly since 2013, involving legal acts, tort and unjust enrichment. In judicial application, there are some problems in judicial application, such as replacing public order and good custom with general moral standard, mixing and separating public order and good custom, and also including judging object error, escaping to general clause and so on. The countermeasures of judicial application of public order and good custom include two aspects: one is to realize the effective communication between external and internal values of civil law, including defining the principle of public order and good custom in order to increase certainty, giving full play to its leading role, and strengthening the distinction and control of principles in civil law. The second is to ensure the scientific application of the principle of public order and good customs, including defining the applicable conditions, adopting the typed application method, summing up the mature types in the judgment and paying attention to the types that have not yet been involved in the judgment of our country, such as the debtor exceeding his expected ability to pay, and the maintenance of basic rights.
