【摘要】：近年來,我國經(jīng)濟(jì)的快速發(fā)展,人們生活水平的提高,汽車數(shù)量飛速增加,住宅小區(qū)停車問題日漸突出。隨之屢有發(fā)生小區(qū)開發(fā)商哄抬車庫、車位價(jià)格,開發(fā)商出售地下人防車庫、車位,車庫、車位無法登記確認(rèn)權(quán)屬等糾紛。本文將對住宅小區(qū)地下車庫、車位進(jìn)行界定,從對地下車庫、車位進(jìn)行法律屬性上的分析,認(rèn)為地下車庫、車位可以作為獨(dú)立的物,成為建筑物區(qū)分所有權(quán)制度調(diào)整的客體。針對目前的理論界的國家所有說、開發(fā)商所有說、業(yè)主共有說等觀點(diǎn)進(jìn)行整理和概括,并逐一進(jìn)行分析得出地下人防車庫、車位歸屬的科學(xué)理論基礎(chǔ)。同時(shí),結(jié)合司法實(shí)際案例,并根據(jù)《物權(quán)法》及最高人民法院《關(guān)于審理建筑物區(qū)分所有權(quán)糾紛案件具體應(yīng)用法律若干問題的解釋》對地下人防車庫、車位權(quán)屬糾紛進(jìn)行實(shí)證分析,并在分析我國立法現(xiàn)狀的基礎(chǔ)上提出符合我國國情的關(guān)于完善建筑物區(qū)分所有權(quán)法律規(guī)定,健全住宅小區(qū)車庫、車位的物權(quán)登記制度的國家立法,建立空間權(quán)作為獨(dú)立的物權(quán)制度等方面的完善建議。
[Abstract]:In recent years, with the rapid development of economy and the improvement of people's living standards, the number of cars has increased rapidly, and the parking problem in residential areas has become increasingly prominent. Subsequently, there are many disputes such as residential developers driving up garages, parking space prices, developers selling underground civil air defense garages, parking spaces, garages, parking spaces can not register to confirm ownership and so on. This paper defines the underground garage and parking space in residential district, analyzes the legal attributes of underground garage and parking space, and holds that underground garage and parking space can be regarded as independent objects and become the object of adjusting the differentiated ownership system of buildings. According to the national ownership of the current theoretical circle, the developers all say, the owner common theory and other views are sorted out and summarized, and the scientific theoretical basis of underground civil air defense garage and parking space ownership is obtained one by one. At the same time, combined with the actual judicial cases, and according to the property Law and the Supreme people's Court's interpretation of the specific application of the law in cases of dispute over the division of ownership of buildings, the underground civil air defense garage is based on the interpretation of the Supreme people's Court. Based on the empirical analysis of parking space ownership disputes, and on the basis of analyzing the present situation of legislation in our country, this paper puts forward the national legislation on perfecting the legal provisions of differentiated ownership of buildings and perfecting the real right registration system of garage and parking space in residential areas. The establishment of space rights as an independent real right system and other aspects of the improvement of suggestions.
