【摘要】：隨著新產(chǎn)業(yè)革命進(jìn)程的深入,共享經(jīng)濟(jì)發(fā)展迅速,共享發(fā)展的理念成為國(guó)家政策的重要內(nèi)容。這對(duì)物權(quán)法的一些基本觀念帶來(lái)了挑戰(zhàn),也要求物權(quán)法律制度的創(chuàng)新。物的私有或獨(dú)享其好處顯而易見(jiàn),私有機(jī)制構(gòu)成一種有效的激勵(lì),促進(jìn)了物的利用。但是,其缺點(diǎn)常常被忽視。從充分發(fā)揮物的效用角度出發(fā),物的共享本身具有著巨大的生態(tài)、道德和效率價(jià)值。同時(shí),物的共享也具有了實(shí)現(xiàn)的物質(zhì)、技術(shù)和心理基礎(chǔ)。在未來(lái)的物權(quán)法發(fā)展中,應(yīng)該重塑立法理念,放棄以絕對(duì)所有權(quán)為中心的觀念,樹(shù)立與協(xié)同共享經(jīng)濟(jì)相互適應(yīng)的共享立法理念。同時(shí)應(yīng)加強(qiáng)共享的制度創(chuàng)新,完善共享的管理規(guī)范,健全共享的組織形式以應(yīng)對(duì)不斷發(fā)展的新經(jīng)濟(jì)形態(tài)對(duì)物權(quán)制度的挑戰(zhàn)。
[Abstract]:With the deepening of the new industrial revolution, the shared economy develops rapidly, and the concept of shared development has become an important part of the national policy. This brings challenges to some basic concepts of property law, and also requires the innovation of the legal system of real rights. It is obvious that the private or exclusive benefits of things, private mechanisms constitute an effective incentive to promote the use of things. However, its shortcomings are often ignored. From the point of view of giving full play to the utility of things, the sharing of things itself has great ecological, moral and efficiency values. At the same time, the sharing of things also has the material, technical and psychological basis of realization. In the development of property law in the future, we should reshape the concept of legislation, give up the idea of absolute ownership as the center, and set up the idea of sharing legislation that adapts to the cooperative sharing economy. At the same time, we should strengthen the system innovation of sharing, perfect the management norm of sharing, and perfect the organizational form of sharing in order to deal with the challenge of the developing new economic form to the real right system.
