【摘要】：隨著我國(guó)城鎮(zhèn)化建設(shè)的不斷發(fā)展,農(nóng)村房屋交易合同不斷訂立,各種各樣的糾紛層出不窮,法院在審判有關(guān)案件時(shí)困惑很多,其判決結(jié)果也是全然不同。關(guān)于農(nóng)村房屋產(chǎn)權(quán)交易制度的爭(zhēng)論已成為當(dāng)前社會(huì)各界倍受關(guān)注、爭(zhēng)議較大的熱點(diǎn)、難點(diǎn)問(wèn)題。本文以我國(guó)農(nóng)村房屋產(chǎn)權(quán)交易制度為研究對(duì)象,以所有權(quán)為交易標(biāo)準(zhǔn),對(duì)我國(guó)現(xiàn)行農(nóng)村房屋產(chǎn)權(quán)交易制度進(jìn)行學(xué)理上的分析,運(yùn)用辯證唯物論的方法以及物權(quán)法和土地管理法等法律中的相關(guān)理論和法律規(guī)定,剖析我國(guó)農(nóng)村房屋產(chǎn)權(quán)交易在理論、立法和司法上存在的困境,為我國(guó)現(xiàn)階段農(nóng)村房屋產(chǎn)權(quán)交易制度提出一些立法上的建議和目前體制下的司法應(yīng)對(duì)策略,以期對(duì)有效解決農(nóng)村房屋產(chǎn)權(quán)交易制度所面臨的法律問(wèn)題具有一定參考價(jià)值。
[Abstract]:With the continuous development of urbanization in our country, the contract of rural housing transaction has been concluded constantly, all kinds of disputes emerge one after another. The court has a lot of perplexity in the trial of related cases, and the result of its judgment is completely different. The debate on the property right transaction system of rural housing has become a hot and difficult issue in the current society. Taking the property right trading system of rural houses in China as the research object and taking the ownership as the transaction standard, this paper makes a theoretical analysis on the current transaction system of rural housing property rights in China. By using the method of dialectical materialism and the relevant theories and legal provisions in the law of property law and land management law, this paper analyzes the dilemma in theory, legislation and judicature in the transaction of rural housing property rights in our country. In order to effectively solve the legal problems faced by the rural housing property right transaction system, this paper puts forward some legislative suggestions and judicial countermeasures under the present system for the present stage of rural housing property right transaction system in our country, so as to have a certain reference value for solving the legal problems faced by the rural housing property right transaction system.
