【摘要】：與個人信息保護在法律制度建構(gòu)層面的進展相對比,在理論層面尚有許多基礎(chǔ)性的問題存在爭議,其中尤為突出的是個人信息的保護范圍問題。域外的相關(guān)理論演進表明,個人信息和個人隱私在保護的價值基礎(chǔ)上存在著顯著的不同,個人信息保護的價值基礎(chǔ)表現(xiàn)為在人際交往過程中對于自身信息利用的控制。以此為標準進行檢視,我國現(xiàn)有民事法律框架中的隱私權(quán)無法完全涵蓋取向于積極利用和掌控的個人信息。通過借鑒德國確立信息自決權(quán)的經(jīng)驗,我國也應當從憲法所規(guī)定的人格尊嚴條款出發(fā),勾連個人信息與人格尊嚴之間的關(guān)系,從"可識別性"和"交互性"兩個角度準確地界定個人信息的保護范圍。
[Abstract]:Compared with the progress of personal information protection in the construction of legal system, there are still many basic issues in the theoretical level, especially the scope of personal information protection. The evolution of relevant theories outside the domain shows that there are significant differences between personal information and personal privacy on the basis of the value of protection. The value basis of personal information protection is the control over the use of their own information in the process of interpersonal communication. Taking this as the standard, the privacy right in the existing civil legal framework of our country cannot fully cover the personal information which is oriented towards active use and control. By drawing lessons from Germany's experience in establishing the right to self-determination of information, our country should also link the relationship between personal information and human dignity, starting from the provisions of the Constitution on human dignity. The protection scope of personal information is defined accurately from the angles of "identifiability" and "interactivity".
