【摘要】：正民法典作為市民社會(huì)的用戶指南,其意義遠(yuǎn)非"一部成文法典"所能概括。那些在不同歷史時(shí)期誕生的偉大民法典,無(wú)不承載著厚重的歷史使命。不難想見,對(duì)于自覺歸入大陸法系的中國(guó)而言,擁有一部民法典,既是愿景,更是心結(jié)。八十多年前,吳經(jīng)熊先生在《新民法和民族主義》一文中無(wú)比自豪地歡呼:"此后中國(guó)已為有《民法典》的國(guó)家了,這是在法制史上何等重要,何等光榮的一頁(yè)!"時(shí)移世易,社會(huì)主義中國(guó)也將在新世紀(jì)迎來(lái)自己的民法典,幾代學(xué)人的夢(mèng)想竟然不經(jīng)意就
[Abstract]:As a user's guide to civil society, the meaning of the Civil Code is far beyond that of a written Code. The great civil codes, which were born in different historical periods, carry a heavy historical mission. It is not difficult to imagine that for China, which consciously belongs to the civil law system, having a civil code is not only a vision, but also a conclusion. More than 80 years ago, Mr. Wu Jing-bear cheered with great pride in his article "New Civil Law and nationalism": "since then, China has become a country with the Civil Code. This is a page of great importance and glory in the history of the rule of law!" When times change, socialist China will also usher in its own civil code in the new century, and the dreams of several generations of scholars have unexpectedly inadvertently made use of it.
