【摘要】：近數(shù)十年來,重金屬污染問題在我國諸多區(qū)域呈高發(fā)態(tài)勢,大規(guī)模重金屬污染侵權(quán)案件不斷涌現(xiàn)。然而在實踐中,重金屬環(huán)境污染侵權(quán)案件的救濟途徑仍存在諸多障礙,司法實務(wù)中遇到的問題比較突出,尤其是因果關(guān)系證明途徑和損害賠償(補償)機制的匱乏。我國《侵權(quán)責(zé)任法》雖然針對環(huán)境污染責(zé)任進行了專門規(guī)定,但由于過于原則和抽象而欠缺可操作性,同時,立法解釋和司法解釋的缺位導(dǎo)致該類案件的審理工作舉步維艱。反思現(xiàn)實困境并對相關(guān)理論的更新和機制的完善進行探索,將有助于我國《侵權(quán)責(zé)任法》在應(yīng)對重金屬環(huán)境污染侵權(quán)問題中更好地發(fā)揮抑制侵權(quán)和彌補損害的重要功能。
[Abstract]:In recent decades, heavy metal pollution in many regions of our country shows a high incidence situation, large-scale heavy metal pollution infringement cases continue to emerge. However, in practice, there are still many obstacles to the relief of heavy metal environmental pollution infringement cases, and the problems encountered in judicial practice are more prominent, especially the lack of causation proof and compensation for damages (compensation) mechanism. Although the Tort liability Law of our country has made special stipulations on environmental pollution liability, it is lack of maneuverability because of too much principle and abstraction. At the same time, the lack of legislative interpretation and judicial interpretation makes the trial of this kind of cases difficult. Reflecting on the realistic predicament and exploring the renewal of the relevant theories and the perfection of the mechanism, it will be helpful for our Tort liability Law to play an important role in restraining the tort and making up for the damage in dealing with the infringement of heavy metal environmental pollution.
