不動產(chǎn)登記機關(guān)的責(zé)任研究

【摘要】:我國著名的法學(xué)家梁慧星教授指出:“在我國社會主義國家不管物權(quán)法最終進行何種的改善與改革,倘若沒有一個真正規(guī)范的不動產(chǎn)登記制度對其進行約束或者限制,那么最終都將導(dǎo)致物權(quán)法向一個不好的方向發(fā)展,不可能順利健康的發(fā)展下去。物權(quán)法所規(guī)定的一切措施和方針也就不可能得到最終的行使與運用!1相比較世界其他很多國家來說,雖然我國的物權(quán)法的建設(shè)也比較早,但是當前我國關(guān)于不動產(chǎn)登記的相關(guān)法律規(guī)定仍然有很多不恰當、不合適的地方。這些都需要我們在今后的工作中予以改正與改善。在我國的《物權(quán)法》真正的頒布與行使前,我國不動產(chǎn)的相關(guān)登記制度并不是由民法規(guī)定的,也不是由其他法律規(guī)定的,而恰恰是由行政法的相關(guān)法律進行的規(guī)定!段餀(quán)法》第21條針對我國不動產(chǎn)登記機關(guān)的相關(guān)責(zé)任問題也只是做了一些籠統(tǒng)性的的規(guī)定,并沒有更加深入的進行說明,這對于當事人的民事救濟都是十分不利的。本文不僅從多方面參考了其他國家的有關(guān)不動產(chǎn)登記的相關(guān)規(guī)定與理論研究,而且還結(jié)合了我國當前不動產(chǎn)登記機關(guān)的基本情況,明確了不動產(chǎn)登記機關(guān)責(zé)任的實現(xiàn)路徑與實現(xiàn)方法。本文除了引言與結(jié)論之外共分為三章:第一章是本文的一個重要的基礎(chǔ)與前提,第一章首先通過一個案例引出了本篇文章所要講述的主要內(nèi)容。然后通過對不動產(chǎn)登記機關(guān)與登記責(zé)任的現(xiàn)狀的描述開啟了本文的分析。筆者通過翻閱資料仔細分析了目前我國不動產(chǎn)登記機關(guān)的賠償責(zé)任的現(xiàn)狀以及目前所面臨急需解決的問題。隨后筆者從正反兩個方面率先明確了不動產(chǎn)登記機關(guān)的責(zé)任性質(zhì),列舉了當前有關(guān)不動產(chǎn)登記機關(guān)責(zé)任性質(zhì)的幾個重要的觀點,并且還分析了我國當前不動產(chǎn)登記機關(guān)存在的現(xiàn)狀以及所包含的缺陷。第二章主要是對不動產(chǎn)登記機關(guān)民事責(zé)任的認定的闡述。首先聯(lián)系了當前的實際情況,分析了當前相關(guān)不動產(chǎn)登記機關(guān)的民事行為;其次分析了不動產(chǎn)登記機關(guān)的相關(guān)民事責(zé)任的責(zé)任后果與因果關(guān)系,最后主要分析了對不動產(chǎn)登記機關(guān)的民事責(zé)任的主、客觀要件進行分析。第三章是對如何分擔與更好地實現(xiàn)救濟進行分析。盡而針對當前存在的一些主要問題提出相關(guān)的建設(shè)性意見,還提出了一些本人自己的觀點與看法。

All these need to be corrected and improved in our future work. Before the real right law of our country was promulgated and exercised, the relevant registration system of real estate in our country was not regulated by civil law or by other laws. However, it is precisely the provisions of the relevant laws of the administrative law. Article 21 of the property Law only makes some general provisions on the related liability of the real estate registration authorities in our country, and does not explain in-depth the question of the responsibilities of the real estate registration authorities in our country. This is very disadvantageous to the civil remedies of the parties concerned. This paper not only refers to the relevant regulations and theoretical research on real estate registration in other countries from many aspects, but also combines the basic situation of the current real estate registration authority in China. The realization path and the realization method of the responsibility of the real estate registration authority are made clear. In addition to the introduction and conclusion, this paper is divided into three chapters: the first chapter is an important foundation and premise of this paper, the first chapter leads to the main content of this article through a case. Then through the description of the real estate registration authority and the status quo of the registration responsibility, this paper starts the analysis. The author carefully analyzes the present situation of the liability of the real estate registration authorities in our country and the problems which are urgently needed to be solved at present through reading the materials. Then the author takes the lead in clarifying the nature of the responsibility of the real estate registration authority from both positive and negative aspects, and enumerates several important points of view on the liability nature of the real estate registration authority at present. At the same time, it also analyzes the present situation and the defects of the real estate registration authority in our country. The second chapter is mainly on the identification of civil liability of real estate registration authorities. Firstly, according to the current actual situation, the civil behavior of the relevant real estate registration authority is analyzed. Secondly, it analyzes the liability consequence and causation relation of the civil liability of the real estate registration authority. Finally, it mainly analyzes the main and objective elements of the civil liability of the real estate registration authority. The third chapter is the analysis of how to share and better realize relief. In this paper, some constructive suggestions are put forward, and some of my own views and opinions are also put forward.
